Planning Commission Minutes <br /> February 27,2001 <br /> Page 15 <br /> • Commissioner Mesich asked if the City Engineer did not feel the entire site should <br /> be commercial. Terry Maurer, City Engineer, stated that he felt this layout best <br /> serves the site. <br /> Scott Powell, applicant, stated that he did not want to impact his neighbors to <br /> the south. He felt the cul-de-sac lends well to a restaurant location. <br /> Chair Mesich asked if Mr. Powell had elevations for the townhomes available. Mr. <br /> Powell stated that elevations were not yet available. <br /> It was the consensus of the Commissioners that a condition #21 be added to <br /> require a conditional use permit for review of the townhome portion of the <br /> project. <br /> Discussion followed regarding the issue of the road connection at the Hanlon <br /> Monument site. Commissioner Mesich asked if the south property (Hanlon <br /> Monument) was not acquired, how long the cul-de-sac would be. Terry Maurer <br /> estimated that it would be approximately 1,000 feet. City Attorney Peter Beck <br /> suggested that the Commission could recommend approval with a condition <br /> that the road connection issue be resolved. Mr. Powell stated that he has made <br /> numerous attempts to negotiate a land exchange with the property owner and <br /> has not been successful. <br /> Commissioner Pederson stated he was in favor of tabling the request until the <br /> issues were resolved. <br /> • Chair Mesich stated that he felt it was a good project, and that MN/DOT would <br /> eventually close the access anyway. <br /> Steve Rohlf spoke in response to Mr. Kirkeide's environmental issues, as outlined in <br /> his letter. Mr. Rohlf specifically addressed the issue of whether or not the City <br /> moving the Wild &Scenic River Boundary constituted a rule change. Mr. Rohlf <br /> said the boundary move was an interpretation of the rules, not a change to <br /> them. <br /> Chair Mesich stated he did not see a reason to table the requests. <br /> Commissioners Schuster and Pederson agreed. <br /> COMMISSIONER PEDERSON MOVED TO RECOMMEND APPROVAL OF THE REQUEST <br /> BY SCOTT POWELL FOR A LAND USE AMENDMENT FROM HB (HIGHWAY BUSINESS)TO <br /> MR (MEDIUM DENSITY RESIDENTIAL) CASE NO. LU 01-03. COMMISSIONER BAKER <br /> SECONDED THE MOTION. THE MOTION CARRIED 7-0. <br /> COMMISSIONER PEDERSON MOVED TO RECOMMEND APPROVAL OF THE REQUEST <br /> BY SCOTT POWELL FOR A REZONING FROM C3 (HIGHWAY COMMERCIAL) TO PUD <br /> (PLANNED UNIT DEVELOPMENT), CASE NO. ZC 01-04, WITH THE FOLLOWING <br /> FINDINGS OF FACT: <br /> 1. THAT THE REZONING IS CONSISTENT WITH THE CITY'S COMPREHENSIVE PLAN <br /> AND ZONING ORDINANCE. <br /> • 2. THAT THE REZONING WILL NOT CREATE ADVERSE IMPACTS TO ADJACENT USES. <br />
