No work, other than 20 foot wide access roads from the lake, is proposed to <br /> take place within the 50 foot shore impact zone. <br /> Top soil will be removed from the disposal sites, the bearing capabilities of the soil <br /> remaining will then be verified and documented, the sediment will then be placed on the <br /> sites according to the plans, top soil replaced, and the sites will be immediately seeded <br /> and mulched. The sediment placed on the Bickman, Hartman and Wapiti Park sites will <br /> contain 2% or less organic matter because they have the potential for development. <br /> The city is responsible for dealing with drainage and odor complaints as well as the <br /> placement and maintenance of erosion control measures for the first year. The sediment <br /> has been tested and does not contain contaminates of concern. <br /> Map "B", the Bickman Disposal site, shows a potential stockpile of material in the <br /> southeast corner. Mr. Bickman is willing to take this material and offer it for sale. This <br /> is why it has been left adjacent to the roadway for access. It is unlikely that there will be <br /> a need for the stockpile, but it should be considered as part of the city's request. <br /> Environmental Concerns <br /> The attached EAW explains in detail the environmental issues and mitigation measures <br /> associated with the proposed project. These issues will not be reiterated in this memo. <br /> IIIIThe Planning Commission is encouraged to review the EAW. The comment period for <br /> the EAW ends on March 25, 1998 so it is anticipated that all comments will be available <br /> for the Planning Commission meeting. <br /> In addition, the city has had the Minnesota Department of Natural Resources (DNR), <br /> Minnesota Pollution Control Agency (MPCA), United States Army Corps of Engineers <br /> (USACE), Minnesota Board of Water and Soil Resources (BSWR), and Sherburne <br /> County Soil and Water Conservation District (SWCD) involved with the project for over <br /> two years. The concerns of the referenced agencies have been including in the project's <br /> design. The project has also been explained to Sherburne County and the Elk River <br /> Watershed Board. <br /> Shoreland Ordinance <br /> The City's Shoreland Ordinance identifies considerations and conditions for grading in a <br /> wetland and Shoreland District; most notably Sections 904.08 3. B. iv. a. and 904.08 7. <br /> A. & B. You may note on the attached disposal plans (Maps A through E) that none of <br /> the work proposed is within the Shore Impact Zone and erosion control measures are <br /> detailed. The project as proposed clearly meets the standards and conditions set forth in <br /> the Shoreland Ordinance. <br /> • <br />
