<br />r- <br /> <br />. <br /> <br /> <br /> <br />SPECIAL SCHEDULED MEETING OF THE <br />ELK RIVER CITY COUNCIL <br />HELD AT THE ELK RIVER CITY HALL <br />THURSDAY, NOVEMBER 15, 1984 <br /> <br />Members Present: <br /> <br />Mayor Hinkle, Councilmembers Engstrom, Duitsman, Schuldt and Gunkel <br /> <br />Members Absent: <br /> <br />None <br /> <br />1. The meeting was called to order at 7:00 p.m. by Mayor Hinkle. <br /> <br />2. Dennis Anderson/Brentwood Roads <br /> <br />Mayor Hinkle indicated that Mr. Dennis Anderson was present to request the City <br />Council to reconsider the $9,400 that the City Council requested to be placed in <br />escrow for future sealcoating of the roads in the Brentwood Addition. Mr. Dennis <br />Anderson indicated that the developer's agreement did not specify the type of bitu- <br />minous mix that should be placed upon roads in a development. Mr. Anderson indicated <br />that the developer's agreement only requested a 2-inch mat for a seven ton road. <br />Mr. Anderson further indicated that the State requires a 23-31 mix and therefore, <br />he felt the City's requirements would be the same as the State's. <br /> <br />Discussion was carried on regarding the first mile of bituminous road in the Brent- <br />wood Addition placed in 1983 with the 23-41 mix and the completion of the roads <br />in the Brentwood Addition in 1984 completed with a 23-31 mix. <br /> <br />The City Administrator indicated that the developer's agreement does not specify <br />the type of mix to be used but does specify that the developer will provide the <br />City with specifications for the roads to be constructed in a development. The <br />City Administrator indicated that the City did not receive a contract between the <br />developer, Dennis Anderson, and Bauerly Brothers, the contractor for the road im- <br />provements in the Brentwood Addition. <br /> <br />General discussion was carried on regarding the contract between Bauerly Brothers <br />and the developer, Mr. Dennis Anderson. <br /> <br />Mr. Phil Hals, Street Superintendent, indicated that he received a copy of the <br />contract between Bauerly Brothers and the developer, Dennis Anderson from Gerry <br />Bauerly on September 4th. Mr. Hals indicated that the mile of paving that was done <br />in 1983 met specifications, therefore, there was no reason to question the contract <br />in 1984. Mr. Hals indicated that when the City's engineer obtained samples of the <br />paving done in 1984, the test showed a 23-31 mix rather than the 23-41 mix required <br />by the City. <br /> <br />Mayor Hinkle indicated that it is projected that the roads will need a seal coat <br />sooner than if the mix were a 23-41 mix. Therefore, the City has requested an <br />amount to be placed in escrow equal to ten percent of the contract which equals <br />$9,400.00. <br /> <br />General discussion was carried on regarding the difference between the composition <br />of the 31 mix and the 41 mix. Mr. Phil Hals indicated that the 31 mix deteriorates <br />faster than the 41 mix. <br />
