Staff recommend <br />with the three conditions listed in the staff report. <br />Mr. Carlton presented the staff report. IWW <br />request <br />Acting Chair Larson -Vito Jill asked additional questions regarding any concerns with <br />wetland setbacks and ordinary bi h w der OH ,) marks for structures or deck <br />footings. <br />Mr. Carlton explained the 25' setback of the sto r pond as well as the 50' <br />setback from the OHW level of Lake Orono which is protected by an easement on <br />the north side and would alleviate any concerns with deck footings. <br />Vice Chair Larson -Vito opened the public hearing. <br />Kyle Miller, 18691 Queen Circle NW, a neighboring property owner, expressed <br />concerns with the mature trees currently located on the western edge of the <br />proposed development bordering the edge of his property and asked if the builder <br />would consider saving as many of them as possible. He also asked what the timeline <br />was for this development and will the city push through the road connection to 186"' <br />Avenue. <br />AW <br />Marcel Eibensteiner, the applicant and president of Royal Oaks Realty Co., 1000 <br />County Road 3, Shoreview, indicated he had also received phone calls from other <br />residents asking for him to save as many trees as possible. He indicated he would do <br />his best to save as many of the mature trees as possible and provide a 25' buffer and <br />if the grading plan required changes, he will modify the grading plan to save trees <br />and shrubs. He also indicated the work on this development, pending Planning <br />Commission and City Council approval, would begin approximately June 1 and <br />finish approximately September 1 of this year.
