The variance will not be injurious to or adversely affect the health, safety or welfare of the residents of the City or the neighborhood where the property is located and will be in keeping with spirit and intent of the ordinance. The granting of the variance will allow the placement of the tower in an industrial area with little or no impact on any residences. The granting of the variance will also allow for improved digital wireless technology for Elk River. Rezoning It is recommended the Planning Commission recommend approval of the rezoning request to AT based on the following findings: 1. The rezoning is compatible with the surrounding land uses and would not adversely affect the property under consideration for rezoning. 2. The proposed rezoning is necessary in order to provide effective wireless telecommunication coverage for the city. 3. The rezoning is in accordance with the Comprehensive Plan for the city. • Conditional Use permit It is recommended the Planning Commission recommend approval of the conditional use permit for a 150 foot wireless telecommunication tower and supporting equipment with the following conditions: 1. The tower be designed to accommodate 2 additional users. 2. The tower and equipment shall be screened from view and surrounded by an 8 foot tall fence. The equipment structure shall be painted to match the existing building. 3. The tower shall be a color that blends in with the surrounding environment. 4. No signs, lighting or advertising are allowed on the tower. 5. The applicant shall supply an intermodulation study to evaluate any potential interference problems. 6.
