Memo to Planning Commission/P 99-8 <br /> June 8, 1999 <br /> Page 6 <br /> IIIf the Commission is comfortable with the parking situation, approval of the <br /> preliminary plat, the conditional use permit for the freestanding retail <br /> building and the conditional use permit for the restaurant/retail building <br /> should include the following conditions: <br /> Preliminary Plat <br /> 1. Drainage and utility easement be shown on the plat per Elk River <br /> Utilities recommendation. <br /> 2. All comments of the City Engineer be addressed. <br /> 3. All necessary cross parking and access agreements be approved by the <br /> City Attorney and recorded with Sherburne County. <br /> Conditional Use Permit Freestanding Retail Building <br /> 1. Windows and trees be provided along the front facade. <br /> 2. The access between Burger King and the drive-thru aisle be eliminated <br /> • and landscaped. <br /> 3. All comments of the City Engineer be addressed. <br /> 4. The Elk River Plaza PUD agreement be amended to allow a 15,000 square <br /> foot retail building and signage as shown on the approved site plan. <br /> 5. All wall signs shall require a sign permit and comply with the Elk River <br /> Plaza PUD agreement. <br /> 6. The landscape plan be approved by the City. <br /> Conditional Use Permit for the Class I Restaurant/Retail Building <br /> 1. The Elk River Plaza PUD agreement be amended to allow the 200 seat <br /> class I restaurant with on-sale liquor and 6,444 square foot retail space as <br /> shown on the approved site plan. <br /> 2. The monument sign be installed as shown on the approved site plan and <br /> receive the required sign permit. <br /> 3.
