Conservation Easement Holders <br /> Several developers were against having the MN Land Trust as the <br /> easement holders, and preferred Homeowners Associations. The <br /> greatest criticism made of the MN Land Trust was their strict open <br /> space criteria. The MN Land Trust requires 50% of the buildable land <br /> be set aside as open space with conservation easements over them, <br /> rather than 50% gross area as Sherburne County requires. This <br /> criteria could prove to be a disincentive to developers and force <br /> conventional development on lands with unique natural features <br /> worthy of saving. <br /> On the other hand, Homeowners Associations may be less willing to <br /> enforce the conservation easements on neighbors, or the organization <br /> might break down over time leaving the City with the responsibility. <br /> • <br /> Request <br /> Staff requests that the Planning Commission review and make final <br /> recommendations regarding an Ordinance Amendment to create an Open <br /> Space Development Overlay District and Ordinance Amendment <br /> • <br /> \\elkriver\sys\shrdoc\planning\stevewen\pcmmo\oa98-3pc.doc <br />
