Ach, City Planner - <br /> DATE: October 22, 1996 <br /> SUBJECT: Elk Terrace Mobile Home Park - <br /> Closure Statement <br /> Overview <br /> On September 24, 1996, the City of Elk River received notice from Earl and <br /> Lorraine Hohlen that the Elk Terrace Mobile Home Court will be closing <br /> pursuant to Minnesota State Statutes 327(c).095. The closure statement that <br /> has been submitted to the City has been prepared in accordance with the <br /> statutory requirements for park closings. The process of closing a mobile <br /> home park involves the local planning agency (planning commission) <br /> submitting the closure statement to the governing body (city council) of the <br /> • municipality and requesting the governing body to schedule a public hearing. <br /> Therefore, the Planning Commission's responsibility at this point is to send <br /> the closure statement to the City Council. Commission is not required to have <br /> a public hearing; this will be the responsibility of the City Council. <br /> The City Council will hold a public hearing to review the closure statement <br /> and any impact that the park closing may have on the displaced residents <br /> and the park owner. The State Statute goes on to outline specific steps and <br /> information that must be provided in completing the closure of a mobile home <br /> park. Staff is working closely with the City Attorney's office, as well as the <br /> developer, to make sure this process is completed accordingly. <br /> Future Development <br /> It is anticipated that with the closure of the mobile home park, prospective <br /> developers of the property will move forward with a possibly commercial <br /> development proposal. This project will most likely be proposed as a planned <br /> unit development and will require the Planning Commission and City <br /> Council review prior to any construction. Therefore, the Planning <br /> Commission will have an opportunity to review all of the applications <br /> necessary in approving a commercial planned unit development at this <br /> • location. <br /> 13065 Orono Parkway • P.O.
