(e) The yard waste composting facility must be operated in such a manner <br /> as to keep odors to a minimum. If odor becomes a problem staff may <br /> require more frequent turning of compost piles and/or watering to <br /> ensure that the compost remains aerobic and breaks down as quickly as <br /> possible. <br /> (f) The maximum amount of yard waste which may be accepted is 100,000 <br /> cubic yards per year. <br /> (g) Positive drainage away from the compost area must be implemented, as <br /> approved by City staff. <br /> (h) Yard waste and/or compost may not be used as daily cover for the <br /> landfill. <br /> (i) That Licensee is in strict compliance with all other terms, conditions <br /> and requirements of this License, including specifically, but not limited <br /> to, the operational requirements, performance standards and <br /> environmental monitoring requirements of sections 4, 6, 7, and 8; and <br /> the requirement of sections 17 and 25 to make prompt payment of all <br /> fees due to the City. No yard waste may be accepted at the yard waste <br /> composting facility if this condition is not complied with. Licensee <br /> must immediately stop accepting yard waste upon written notice from <br /> the City that there is a violation of this condition. <br /> (03) Demolition Debris. The operation of a demolition debris landfill on the <br /> Landfill Property may be conducted, if in conformance with all applicable terms and <br /> conditions of this License, subject to the following conditions: <br /> (a) The operation of the demolition debris landfill shall comply in all <br /> respects with all applicable requirements of the City Code of <br /> Ordinances and all applicable federal, state and county laws and <br /> regulations. <br /> (b) The demolition debris landfill shall be located and operated as shown <br /> on plans submitted by Licensee and approved by City staff. <br /> (c) Licensee shall provide an estimated development time line for the <br /> demolition debris landfill, including an estimated closure timeline, <br /> which shall be updated as appropriate. <br /> (d) Licensee shall pay the demolition debris surcharge authorized by Minn. <br /> Stat. § 115A.921, Subd. 2. The Surcharge shall be paid directly to the <br /> City on a monthly basis, and shall be accompanied by an accurate <br /> • <br /> PXB 100940 5. <br />
