d. That a detailed storm drainage plan is provided by the <br /> • developer and approved by City Engineer. Further, <br /> that all improvements needed to assure that no <br /> negative impact due to storm water from this <br /> development will occur on-site or off-site are the <br /> responsibility of the Developer . <br /> e. A pathway (minimum 6 foot wide concrete sidewalk) <br /> along the north side of Elk Hills Drive and the east <br /> side of Dodge Avenue at the expense of the Developer . <br /> If sufficient right-of-way is not available after the <br /> upgrading of Dodge Avenue to four lanes, the Developer <br /> may dedicate an easement to the City for said pathway. <br /> The maintenance of the pathway would be the <br /> responsibility of adjacent property owners in the PUD. <br /> f . The Developer pay the City for the first seal coating <br /> of the upgraded portion of Dodge Avenue in an amount <br /> estimated by the City Engineer. <br /> g. The Developer pay the City park dedication fees in the <br /> amount required at the time of the subdivision of this <br /> Property. <br /> h . Street lights are to be provided, the numbers and <br /> location of which would be determined by City staff . <br /> • The cost of the lights and the installation of them <br /> are the responsibility of Developer. <br /> i . The Developer shall reimburse the City for all costs <br /> incurred for reviewing this proposed subdivision, and <br /> the inspection of associated improvements . <br /> j . That a letter of credit be provided to the City, by <br /> the Developer, to assure the improvements are <br /> accomplished. <br /> k. That the above-referenced improvements are <br /> accomplished prior to occupying any buildings within <br /> this PUD. <br /> 1 . That a developer' s agreement is entered into <br /> stipulating the above mentioned requirements whether <br /> the council requires platting of this property or <br /> allows the split as an administrative subdivision . <br /> ( 02 ) That those uses allowed as principal and conditional <br /> uses within the C-2 zone and retail uses be allowed within <br /> this PUD as they exist at the time of specific site plan <br /> review. Those uses that are conditional uses within the <br /> C-2 zone and all retail uses would require an additional <br /> conditional use permit to be issued for their approval <br /> • within this PUD. <br /> 3 . <br />
