Mineral Excavation Page 2 <br /> Case No.ZU 94-09 <br /> Continued <br /> • be considered prior to approving mineral excavation. Further, any and all <br /> mining must be consistent with the long range planning and findings of the <br /> Environmental Impact Statement prepared by the City. <br /> This rezoning of the mining district is the logical next step in the City's <br /> attempt to better regulate mining activities. The first step in this process <br /> was the Environmental Impact Statement. The next step, after the zone <br /> change, will be updating any antiquated existing mining permits. An <br /> ongoing step is to better administer the yearly licenses. <br /> Staff is recommending approval of this zone change request with the <br /> exception of the northeast quarter of the southwest quarter of Section 20, <br /> Township 33, Range 26 (Shown on Map B with an X through it). This parcel <br /> is currently not owned or leased by gravel companies and makes a logical <br /> separation from mining activities to adjacent neighborhoods. <br /> Staff also considered not rezoning areas where setbacks from mining <br /> activities would be required. However, it was too difficult to predetermine <br /> these buffers at this time. This task would be easier to accomplish on a case <br /> by case basis through the Conditional Use Permit process. <br /> • Staff offers the following findings for recommending approval of this <br /> rezoning: <br /> 1. The rezoning is consistent with the long range planning put <br /> forth in the Environmental Impact Statement on mineral <br /> excavation. It is also consistent, Section 910 (18) "Mineral <br /> Excavation Overlay Zoning District", and Section 900.44 <br /> "Amendment Procedures" of the City of Elk River Zoning <br /> Ordinance. <br /> 2. The rezoning would help conserve property values by putting <br /> surrounding property owners on notice of the intent of the <br /> property owners within the mining district, to extract gravel. <br /> Also, through the Conditional Use Permit process, other <br /> safeguards to protect property values can be instituted. <br /> 3. The rezoning is consistent with the use the properties in <br /> question are being devoted to at this time. <br /> Further, any and all mining must be consistent with the long range planning <br /> and findings of the Environmental Impact Statement prepared by the City. <br /> • <br /> PC-mnrl/PC <br />
