C.U.P. 94-31 Page 4 <br /> Continued <br /> • operation demonstrating that they can control noise to reasonable <br /> levels, before extended hours are even considered. <br /> The City has made only one exception to the hours of operation for <br /> mineral excavation. That exception was the Baurerly pit, off of County <br /> Road 21, where they crushed gravel for approximately 10 to 14 days <br /> per year. The neighbors were in favor of extended hours to reduce the <br /> number of days crushing would take place. <br /> PARK DEDICATION <br /> Typically, Park Dedication is not an issue with a Conditional Use Permit. <br /> However, a portion of the Shiely site, located in the southwest corner, is an <br /> old growth dry oak sub type forest, classified as threatened by the DNR. <br /> Shiely is offering to dedicate 50 acres of this old growth forest now, in <br /> consideration of forgiveness of part of their future park dedication. <br /> Because the land in question is a logical extension of Woodland Trail Park <br /> and is a significant natural setting, the Park and Recreation Commission <br /> recommended the City accepts Shiely's offer and negotiate the purchase of <br /> additional acres besides. City staff will be discussing these issues with the <br /> Shiely Company. Staff encourages the Planning Commission to recommend <br /> • <br /> (in a motion separate from Shiely's Conditional Use Permit motion) that the <br /> City Council accepts this offer. <br /> RECOMMENDATION <br /> Staffs recommended conditions are a product of numerous meetings and <br /> telephone calls with City consultants, the County Engineer, the Shiely <br /> Company, and representatives of the neighborhoods of Ridgewood and <br /> Greenhead Acres. With these conditions placed on this operation, staff feels <br /> that the seven standards for approving a Conditional Use Permit can be met. <br /> We recommend approval of Shiely's permit under the following findings and <br /> conditions: <br /> Findings <br /> 1. That the conditions placed on the operation adequately protect <br /> adjacent neighborhoods and the City form detrimental affects from the <br /> operation due to excessive traffic, noise, smoke, fumes, glare, odor, <br /> dust, or vibrations. <br /> III <br /> geryl-BZ <br />
