<br /> This letter is in response to your request for our opinion with respect
<br /> to the proposed rezoning of the Custom Motors site.
<br /> BACKGROUND
<br /> It is our understanding that the Custom Motors site is located in an
<br /> area of the City of Elk River (the City) which is primarily residential
<br /> and which is designated by the City' s land use map for residential use.
<br /> However, the Custom Motors site itself was rezoned from A-1 , Agricultural
<br /> Conservation District, to 1-2 Medium Industrial District, b

<br /> Council on November 3, 1978, and retains this zoning designation attthe
<br /> present time. The City Council also, on November 3 , 1978 , granted a
<br /> Conditional Use Permit to Custom Motors
<br /> a salvage yard, bodyshop, Permitting use of the site as
<br /> The Conditional Use yPermitmwasagrantedresubjepair ctetoacertainkconditions,
<br /> the most significant of which is appropriate screening. It is our
<br /> understanding that the site has been used as a salvage yard, bodyshop,
<br /> mechanical repair area and truck dealership in the period since 1978,
<br /> and that, while there was some delay in doing so, the required screening
<br /> has now been put in place.
<br /> You have advised us that the Planning Commission, in connection with a
<br /> comprehensive review of nonconforming in
<br /> land uses in the City, has determined�that othe sindustrialnusexofrthe®
