Stevens ' Conditional Use Permit Page 2
April 20, 1993
• The Stevens ' are proposing to exceed the above mentioned
standards by having a single, detached, non agricultural
accessory structure that measures 30 feet by 54 feet, for a
total of 1, 620 square feet. Attached is a site plan showing
the Stevens ' house and the proposed location of the accessory
structure.
PROCESS
The mechanism to allow exceptions to the three standards the
Stevens ' wish to exceed is a conditional use permit. Staff
refers the Planning Commission to Section 900 . 42 of the Elk
River Code of Ordinances for the seven standards to consider
when reviewing a conditional use permit request.
Attached is a letter from the Stevens ' dated April 1, 1993 . In
this letter they point out that a precedence for larger metal
skin buildings has been established in their neighborhood
(Greenhead 3rd Addition) . Further, allowing an encroachment on
the 300 foot setback will allow their building to be built
among trees and, therefore, screened naturally. The attached
site plan shows the distance from the proposed accessory
structure to a lot lines but does not show the distances to
neighboring residences .
• The Stevens ' have also provided pictures showing other
accessory structures in Greenhead 3rd Addition that are over
the 1, 000 square foot size limitation. Staff will present
these photographs to the Planning Commission at the meeting.
One last note, the Stevens ' currently do not have any detached
accessory structures on their property, only an attached garage.
RECOMMENDATION
Staff agrees with the Stevens ' that there is a precedence in
Greenhead 3rd Addition for larger, non agricultural, detached
accessory structures . Further, the lots in Greenhead 3rd
Addition are larger and more conducive to this type of
building. If the Planning Commission recommends approval, the
outside appearance of this building should be taken into
consideration. The Stevens ' should also be put on notice that
businesses are not permitted in this building.
411
