Adopt,by motion, an ordinance amending Chapter 38 regarding Peddler's, Solicitors,Transient
Merchants, and Mobile Food Units.
2. Adopt,by motion, a resolution for summary publication of the ordinance.
Background/Discussion
Council had held numerous meetings to discuss food trucks. Concern has been centered on where food
trucks should be allowed to park in the downtown zoning district. Consensus at the last meeting was to
allow a designated parking area on King Avenue and on private property in the downtown district, but
only one truck could be allowed in the district at a time.
Since the last meeting,Mayor Dietz contacted me and indicated he would like to see food trucks allowed
to operate during concert nights at the park. He also expressed concerns with one truck monopolizing the
downtown district location.
Below is draft language for discussion at tonight's meeting:
1) Locations. Mobile food units shall be allowed in public right-of-way only in zoning districts
where retail sales are allowed as permitted or special uses under the city's zoning code.
Except that mobile food units may be located on privately owned property in the
Commercial, and Industrial zoning areas of the city with written property owner permission
and Residential lots as exempted per Section 383 (11).
In the Downtown District only one mobile food unit shall be permitted and is allowed to
operate in the following locations:
a) The designated, signed parking area along King Avenue
b) Privately-owned parking areas
Reservations are not permitted when the city hosts concert nights in River's Edge Park
unless authorized btv Council. City Council may further authorize mobile food units in
the downtown district for city-sanctioned activities.
The Elk River Vision
A PehoMing community 2a itb revolutionary and spirited resourcefulness, exceptional POWERED By
service, and community engagement that encourages and inspires prosperity INAWRE1
