LEGALLY DESCRIBED AS <br />THAT PORTION OF GOVERNMENT LOT 3. SECTION 6. TOWNSHIP 32. RANGE 26. <br />EXCEPT THE WEST 300 FEET. INTO THREE LOTS. COUNCILMEMBER HOLMGREN <br />SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />5.3. Variance Request by Richard Gatzke/Public Hearing <br /> <br />Mayor Gunkel indicated that Mr. Richard Gatzke is requesting a variance <br />so he can avoid building his house on low ground in lot 1. Block 2. Oak <br />Meadows Addition. She stated that Mr. Gatzke needs a variance for a 6 <br />foot encroachment on the 50 foot front yard setback required in an A-1 <br />zone. <br /> <br />The Building and Zoning Administrator indicated that the Planning <br />Commission approved the variance and felt it was in the spirit and intent <br />of the ordinance. <br /> <br />Mayor Gunkel opened the public hearing. No one appeared for or against <br />the matter. Mayor Gunkel closed the public hearing. <br /> <br />e <br /> <br />COUNCILMEMBER TRALLE MOVED TO APPROVE THE VARIANCE REQUEST BY MR. RI CHARD <br />~'l'ZI(l: 'OR PROPERTY LOCATED ON LOT 1. BLOCK 2, OAK MEADOWS ADDITION. TO <br />ALLOW A 6 FOOT ENCROACHMENT ON THE FRONT YARD SETBACK TO BUILD A HOUSE. <br />cOUNCILM!MBER HOLMGREN SECONDED THE MOTION. THE MOTION PASSED 5-0. <br /> <br />5.4. Variance Request by Alan Niemela/Public Hearing <br /> <br />Mayor Gunkel indicated that Mr. Alan Niemela is requesting a variance for <br />a 30 foot encroachment from the 50 foot setback required from Lake Orono <br />and a 15 foot encroachment to the front yard setback to accommodate a <br />garage. <br /> <br />The Building and Zoning Administrator indicated that the Planning <br />Commission recommended aproval of the variance with the stipulation that <br />Mr. Niemela complete work from a 1983 remodeling permit prior to getting <br />the permit for the garage. <br /> <br />Mayor Gunkel opened the public hearing. No one appeared for or against <br />the matter. Mayor Gunkel closed the public hearing. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE THE VARIANCE REQUESTED BY ALAN <br />NIEMELA OF 1862 MAIN STREET. FOR A 30 FOOT ENCROACHMENT ON THE SETBACK <br />FROM LAKE ORONO AND ALSO FOR A 15 FOOT ENCROACHMENT ON THE FRONT YARD <br />SETBACK TO BUILD A GARAGE ON PROPERTY LOCATED ON LOT 1. BLOCK 4. ORONO <br />ADDITION AFTER HIS 1983 REMODELING PERMIT IS SATISFIED. COUNCILMEMBER <br />HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />e <br />
