<br />Page 10 <br /> <br />City Council Minutes <br />April 20. 1987 <br /> <br />e <br /> <br />Mayor Gunkel opened the public hearing. No one appeared for or against <br />the matter. Mayor Gunkel closed the public hearing. <br /> <br />COUNCILMEMBER DOBEL MOVED TO APPROVE THE PRELIMINARY PLAT OF ELK RIVER <br />INDUSTRIAL PARK 2ND ADDITION. COUNCILMEMBER HOLMGREN SECONDED THE <br />MOTION. THE MOTION PASSED 5-0. <br /> <br />5.19.Preliminary Plat Review of Fairhaven Hills/Jeff Mastley/Public Hearing <br /> <br />Mayor Gunkel indicated that Jeff Mastley. Peter Newland and Douglas <br />Serdall are requesting preliminary plat review of Fairhaven Hills which <br />consists of approximately 85 acres to be divided into 29 lots. <br /> <br />Planning Commission representative. Stewart Wilson. stated that the <br />Planning Commission unanimously recommended approval of the preliminary <br />plat. He noted that discussion was held regarding the easement beyond <br />the cul-de-sac to the south of the proposed Troy Street and that it not <br />be tarred but just rough graded and seeded. He further stated that <br />discussion was held regarding the fact that this road not be used by <br />snowmobiles. etc. and that there be a fence at the property line across <br />the road to prevent people from accessing this piece of property. <br /> <br />e <br /> <br />The Building and Zoning Administrator noted that lots 1. 2 and 3. of <br />Block 3. would need a lot size variance of about .2 of an acre each. He <br />noted he is requesting that the public hearing for the variance be held <br />at Council level only because of time limitations. but further noted that <br />the Council will have the Planning Commission comments on the variance. <br /> <br />Mayor Gunkel opened the public hearing. <br /> <br />Mr. Irv Moldenhauer questioned where the property was located. <br /> <br />Mayor Gunkel closed the public hearing. <br /> <br />The City Administrator noted that the City should exercise caution when <br />approving plats with variances because of the fact that they are dealing <br />with raw land. <br /> <br />The Building and Zoning Administrator noted he felt this was not an <br />arbitrary variance but felt it was the best use for the land. <br /> <br />Discussion was held regarding the variance request. Duane Kropuenske of <br />the Planning Commission stated that the Planning Commission felt the <br />variance would be the best possible answer for the land. Mr. Marly <br />Glines stated that the reasons for the variance request is to allow for <br />better road layout and better building sites. <br /> <br />e <br /> <br />COUNCILMEMBER TRALLE MOVED TO APPROVE THE PRELIMINARY PLAT OF FAIRHAVEN <br />HILLS AS PRESENTED WITH THE STIPULATION THAT ITEMS 1 THROUGH 9 IN THE <br />MEMORANDUM FROM THE BUILDING AND ZONING ADMINISTRATOR DATED APRIL 16, <br />1987. BE ADHERED TO AND FURTHER THAT THE ROAD AT THE END OF THE CUL-DE- <br />SAC AND PROPERTY LINE BE FENCED. COUNCILMEMBER SCHULDT SECONDED THE <br />MOTION. THE MOTION PASSED 5-0. <br />
