Page 7 e City Council Minutes March 16. 1987 Mayor Gunkel opened the public hearing. There being no public comment regarding this matter. Mayor Gunkel closed the public hearing. Councilmember Schuldt questioned the by-laws and what they dealt with. Gary Santwire responded by indicating that the finished copy of the by-laws are about 20 to 30 pages in length and will deal with both owners. COUNcILMEMBER TRALLE MOVED APPROVAL OF THE ADMINISTRATIVE SUBDIVISION REQUEST BY FIRST NATIONAL BANK WITH THE STIPULATIONS IMPOSED BY THE PLANNING COMMISSION AND THAT NO PARK DEDICATION FEE BE PAID BECAUSE THE PROPERTY IS COMMERCIAL.AND THAT THE CITY ATTORNEY REVIEW THE BY-LAWS AND CHARGE THE FEES BACK TO THE DEVELOPER WHICH SHALL BE PAID PRIOR TO THE RECORDING OF THE ADMINISTRATIVE SUBDIVISION~ COUNCILMEMBER HOLMLGREN SECONDED THE MOTION. THE MOTION PASSED 5-0. 7.5. Cable TV Franchise Transfer Resolution/Public Hearing tit Gary Matz. representing Jones Intercable presented a resolution to the Council which would authorize the assignment and transfer of the cable communications franchise to construct. operate and maintain a cable communications system. Mr. Klaers stated that he is a member of the Cable Commission and that they met at a public hearing to consider this resolution. He noted Mr. Matz is present with changes in the resolution. Mr. Matz stated that they are requesting two changes and that these changes are only clarification changes. Mayor Gunkel opened the public hearing. No one appeared for or against the matter. Mayor Gunkel closed the public hearing. The City Administrator informed the Council that even though the changes proposed do not affect the intent of the agreement. the Cable Commission Attorney has not yet had a change to respond to these proposed changes. COUNCILMEMBER TRALLE MOVED TO APPROVE RESOLUTION 87-17, A RESOLUTION AUTHORIZING THE ASSIGNMENT AND TRANSFER OF A CABLE COMMUNICATIONS FRANCHISE TO CONSTRUCT. OPERATE AND MAINTAIN A CABLE COMMUNICATIONS SYSTEM CONTINGENT UPON FAVORABLE RECOMMENDATION BY THE CABLE ATTORNEY. COUNCILMEMBER SCHULDT SECONDED THE MOTION. Mr. Gary Resolution wording. " Matz stated contingent he would like the motion to state approval of "that the Cable Attorney has no objection to the - COUNcILMEMBER TRALLE MOVED TO AMEND THE MOTION TO STATE "CONTINGENT UPON '!'HE CABLE ATTORNEY HAVING NO OBJECTION TO THE WORDING. n COUNCILMEMBER SCHULDT SECONDED THE AMENDMENT.
