Mayor Gunkel closed the public hearing. <br /> <br />Councilmember Schuldt questioned the by-laws and what they dealt with. <br />Gary Santwire responded by indicating that the finished copy of the <br />by-laws are about 20 to 30 pages in length and will deal with both <br />owners. <br /> <br />COUNcILMEMBER TRALLE MOVED APPROVAL OF THE ADMINISTRATIVE SUBDIVISION <br />REQUEST BY FIRST NATIONAL BANK WITH THE STIPULATIONS IMPOSED BY THE <br />PLANNING COMMISSION AND THAT NO PARK DEDICATION FEE BE PAID BECAUSE THE <br />PROPERTY IS COMMERCIAL.AND THAT THE CITY ATTORNEY REVIEW THE BY-LAWS AND <br />CHARGE THE FEES BACK TO THE DEVELOPER WHICH SHALL BE PAID PRIOR TO THE <br />RECORDING OF THE ADMINISTRATIVE SUBDIVISION~ COUNCILMEMBER HOLMLGREN <br />SECONDED THE MOTION. THE MOTION PASSED 5-0. <br /> <br />7.5. <br /> <br />Cable TV Franchise Transfer Resolution/Public Hearing <br /> <br />tit <br /> <br />Gary Matz. representing Jones Intercable presented a resolution to the <br />Council which would authorize the assignment and transfer of the cable <br />communications franchise to construct. operate and maintain a cable <br />communications system. Mr. Klaers stated that he is a member of the <br />Cable Commission and that they met at a public hearing to consider this <br />resolution. He noted Mr. Matz is present with changes in the <br />resolution. <br /> <br />Mr. Matz stated that they are requesting two changes and that these <br />changes are only clarification changes. <br /> <br />Mayor Gunkel opened the public hearing. No one appeared for or against <br />the matter. Mayor Gunkel closed the public hearing. <br /> <br />The City Administrator informed the Council that even though the changes <br />proposed do not affect the intent of the agreement. the Cable Commission <br />Attorney has not yet had a change to respond to these proposed changes. <br /> <br />COUNCILMEMBER TRALLE MOVED TO APPROVE RESOLUTION 87-17, A RESOLUTION <br />AUTHORIZING THE ASSIGNMENT AND TRANSFER OF A CABLE COMMUNICATIONS <br />FRANCHISE TO CONSTRUCT. OPERATE AND MAINTAIN A CABLE COMMUNICATIONS <br />SYSTEM CONTINGENT UPON FAVORABLE RECOMMENDATION BY THE CABLE ATTORNEY. <br />COUNCILMEMBER SCHULDT SECONDED THE MOTION. <br /> <br />Mr. Gary <br />Resolution <br />wording. " <br /> <br />Matz stated <br />contingent <br /> <br />he would like the motion to state approval of <br />"that the Cable Attorney has no objection to the <br /> <br />- <br /> <br />COUNcILMEMBER TRALLE MOVED TO AMEND THE MOTION TO STATE "CONTINGENT UPON <br />'!'HE CABLE ATTORNEY HAVING NO OBJECTION TO THE WORDING. n COUNCILMEMBER <br />SCHULDT SECONDED THE AMENDMENT. THE AMENDMENT PASSED 5....0. <br /> <br />'!'HE MOTION AS AMENDED PASSED 5-0. <br />
