Request for Action

To Item Number
Mayor and City Council 4.3
Agenda Section Meeting Date Prepared by
Consent March 19, 2018 Zack Carlton, Planning Manager
Item Description Reviewed by
Easement Vacation: Pipe Portfolio Peter Beck, City Attorney
Reviewed by
Cal Portner, City Administrator

Action Requested
1. Approve, by motion, the Grant of Permanent Easements Agreement, granting the city eight separate utility
easements for water and sewer lines on the Pipe Portfolio property.
2. Approve, by motion, the Utility and Ingress and Access Easement Agreement connecting Quinn Avenue
and the city water tower property providing the city permanent, legal access to the water tower.
3. Approve, by motion, the License Agreement granting Forterra (Pipe Portfolio) permission to store
materials and park on portions of the city-owned water tower property.
4. Approve, by motion, the Quit Claim Deed to Pipe Portfolio, which conveys any residual interest in
the previously vacated rights of way to Pipe Portfolio.

Background/Discussion
On April 17, 2017, the City Council approved a number of actions to vacate unnecessary rights of way
th
and easements on the Forterra (Pipe Portfolio) property located at 1340 6 Street NW, and replaced
those rights of way and easements with new, generally wider, easements for the existing water, sewer, and
electric utility lines on the property. The approval also provided staff with the authority to make minor
adjustments to the approved documents based on the continued discussions with Forterra.

The follow-up discussions with Forterra resulted in more document changes than anticipated including
quit claim deed. Therefore, the city attorney is requesting a second review and approval from the Council.
There has been no change to the basic agreement, just some revisions and additions to the documents.
The city attorney recommends the Council approve the revised documents to implement the agreement.

Financial Impact
None

Attachments
City Council Packet dated April 17, 2017
Grant of Permanent Easements
Utility and Ingress and Access Easements
License Agreement
Quitclaim Deed (City to Pipe Portfolio)
Quitclaim Deed (Pipe Portfolio to City)
Easement Depictions

The Elk River Vision
A welcoming community with revolutionary and spirited resourcefulness, exceptional
service, and community engagement that encourages and inspires prosperity
