The Elk River Vision
A welcoming community with revolutionary and spirited resourcefulness, exceptional
service, and community engagement that encourages and inspires prosperity
Request for Action
To
Planning Commission
Item Number
4.2
Agenda Section
Public Hearings
Meeting Date
February 27, 2018
Prepared by
Chris Leeseberg, Senior Planner
Item Description
Ordinance Amendment
Chapter 30 Definitions, OA 18-02
Reviewed by
Zack Carlton, Planning Manager
Reviewed by
Action Requested
Recommend, by motion, approval of the Ordinance Amendment as proposed.
Background/Discussion
Many of our permitted, accessory, and conditional uses are not defined in the city ordinance. The
purpose of this amendment is to clarify what terms/uses mean, and to minimize overlap of like meanings
and uses.
The proposed definitions were drafted utilizing the American Planning Association Planners Dictionary.
This is a document that has a variety of definitions for various planning terms from governing agencies
across the county.
Definitions that have been struck may be:
Removed entirely as the term no longer appears in Chapter 30.
Located elsewhere for consistency and clarity with similar uses. For example, Area identification sign
was moved to Sign, area identification.
Combined with other like definitions. For example, Government buildings and facilities and Government
offices were combined into Government facility.
There are some lengthy definitions proposed, such as Accessory Dwelling Units and Motor Vehicle Repair
Shops, so they do not have to be repeated with their lengthy regulations each time that use appears in a
given zoning district.
Not all uses listed in each district have a definition, as staff thought some are self-explanatory. For
example, Zero Lot Line development and Concrete/asphalt products and processing.
The Planning Commission reviewed the proposed definitions at their work session on January 23, 2018.
There was discussion on Salvage Yards and the concern regarding the language of “two or more
inoperative vehicles” and how many current residential properties are ‘operating’ a salvage yard due to
vehicles being stored on their properties. It was noted inoperative/unlicensed vehicles, regardless of how
many, are not allowed on residential parcels.
