He also described the preparation and negotiations of the <br />documents. Mr. Korstad explained that plans for hydrological monitoring <br />will need to be approved by the City. Mr. Korstad also recommended <br />approval of the documents. <br /> <br />Stephen Rohlf. Building and Zoning Administrator. explained that Staff <br />and the Planning Commission recommended rezoning of only the northern 2 <br />parcels to SWF.but that the area to be rezoned. should also include the <br />site around the existing office. <br /> <br />Peter Kimball. Planning Commission member. stated he believes the rest of <br />the Planning Commission would have no objection to the rezoning of the <br />area around the office. <br /> <br />Steve Rohlf explained that the Planning Commission recommended approval <br />of the CUP with only minor changes. He also explained the buffer zone <br />around the landfill. <br /> <br />There was general discussion as to the monitering of wells. It was <br />indicated that both residential and landfill wells will be tested. <br /> <br />e <br /> <br />Mayor Gunkel commended all parties on the development of the documents. <br />She also questioned the word "adequate" in the CUP. Mr. Korstad <br />explained the meaning of adequate. <br /> <br />Counci1member Tra11e questioned the similarity of CUP and license. <br />Mr. Korstad explained that the license allows for more flexibility to <br />address new technologies. <br /> <br />Pat Klaers. City Administrator. explained that a resident in attendance <br />was concerned about the testing of residential wells. Mr. Korstad <br />explained the testing policy. <br /> <br />Counci1member Holmgren questioned what "imdemnity" meant. He also <br />questioned the transfer of the license. Mr. Korstad addressed both these <br />issues. <br /> <br />Mayor Gunkel closed the Public Hearing at 7:52 p.m. <br /> <br />COUNCILMEMBER TRALLE MOVED TO ADOPT ORDINANCE 88-26. AN ORDINANCE <br />AMENDING THE ZONING ORDINANCE FROM A-I TO SOLID WASTE FACILITY OVERLAY <br />REQUESTED BY ELK RIVER LANDFILL FOR THE NORTHERN TWO PARCELS OWNED BY THE <br />LANDFILL AND THE NORTH 525 FEET OF THE SOUTHERN PARCEL THAT INCLUDES THE <br />LANDFILL OFFICE. COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION <br />CARRIED 4-0. <br /> <br />e <br /> <br />COUNCILMlMBER DOBEL MOVED TO APPROVE THE CONDITIONAL USE PERMIT TO <br />OPERATE A LANDFILL REQUEST BY ELK RIVER LANDFILL~ COUNCILMEMBER TRALLE <br />SECONDED THE MOTION. THE MOTION CARRIED 4-0~ <br /> <br />(j@UNCILMlMB!R HOLMGREN MOVED TO APPROVE THE LICENSE AGREEMENT BETWEEN THE <br />CITY AND ELK RIVER LANDFILL. COUNCILMEMBER TRALLE SECONDED THE MOTION. <br />THE MOTION CARRIED 4-0. <br />
