<br />City Council Minutes <br />August 20, 1990 <br /> <br />Page 2 <br /> <br />e <br /> <br />stated that this would be a detriment to the commercial and industrial <br />business coming into Elk River. <br /> <br />Councilmember Kropuenske stated that he realizes the City Council <br />reviewed and approved this ordinance, but felt the Council should look <br />at the ordinance again. Councilmember Kropuenske indicated that with <br />44 square miles in Elk River, it is impossible to have all of the <br />City's industrial land platted because of the cost involved. He <br />indicated that the City should look at putting together a simplified <br />platting mechanism for commercial and industrial business. <br /> <br />Councilmember Schuldt stated that it was not the intent of the <br />ordinance to penalize industrial development. <br /> <br />It was the consensus of the Council to review this ordinance again at a <br />later date. <br /> <br />Discussion pursued regarding the predicament that John Plaisted was in <br />due to the adoption of this ordinance. It was suggested that Mr. <br />Plaisted be issued a building permit so that he could start <br />construction, but that no occupancy permit be issued until the area is <br />platted. It was also suggested that Mr. Plaisted could go through an <br />administrati ve subdivision rather than the regular platting procedure, <br />which would save him time. <br /> <br />e <br /> <br />COUNCILMEMBER KROPUENSKE MOVED THAT THE CITY COUNCIL INSTRUCT THE <br />BUILDING AND ZONING ADMINISTRATOR TO ISSUE A BUILDING PERMIT TO MR. <br />PLAISTED, BUT THAT THE OCCUPANCY PERMIT FOR THE BUILDING NOT BE ISSUED <br />UNTIL THE PLATTING PROCESS, THROUGH AN ADMINISTRATIVE SUBDIVISION, IS <br />WORKED OUT BY STAFF AND CITY COUNCIL. COUNCILMEMBER DOBEL SECONDED THE <br />MOTION. THE MOTION CARRIED 4-0. <br /> <br />Vice Mayor Schuldt informed the audience that staff is recommending to <br />table Item 5.6 so that the Growth Management Plan text can be amended <br />prior to adding the zone changes and land use changes. He informed the <br />public that this will be held on September 17, 1990, at 7:00 at the Elk <br />River Public Library. Vice Mayor Schuldt informed the public that they <br />may either wait until 5.6 comes up on the agenda and voice their <br />opinion at that time or they may come back to the September 17 meeting <br />as this will be a continued public hearing of this item. <br /> <br />e <br /> <br />Pat DeMars indicated that he was present two weeks ago to inform the <br />Council of the flooding problems he is experiencing on his property at <br />429 Line Avenue. He stated that' since that last Council meeting he has <br />investigated the situation and does not feel that the flooding is <br />caused from the blocked cuI vert. He stated that there is a holding <br />pond in his area to accommodate the surrounding properties; however, <br />there is no outlet to the holding pond and when the holding pond is <br />full, the water goes onto his land and floods his basement. He stated <br />that his property gets flooded before the water reaches the blocked <br />
