COUNCILMEMBER <br />DIETZ SECONDED THE MOTION CARRIED 4-0. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO CONVEY THE TITLE OF THE PROPERTY FROM <br />THE CITY TO ELK RIVER ECONOMIC DEVELOPMENT AUTHORITY. COUNCILMEMBER <br />DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />4.3. Fillmore Appraisal <br /> <br />Mayor Tralle indicated that the City has received an appeal to an <br />assessment for the Fillmore Avenue project from Mr. and Mrs. Scott <br />Mitchell. He further indicated that it would appropriate for the City <br />to obtain an appraisal on the land valuation as it relates to the <br />project. <br /> <br />The City Administrator suggested that the Council allow possibile <br />negotiation of the assessment with Mr. and Mrs. Mitchell due to the <br />cost which would be incurred if this assessment appeal were to go to <br />court. <br /> <br />e <br /> <br />COUNCILMEMBER DIETZ MOVED TO APPROVE THE HIRING OF AN APPRAISER IF <br />NECESSARY AND TO ALLOW STAFF TO NEGOTIATE THE ASSESSMENT APPEAL BY MR. <br />AND MRS. MITCHELL. COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE <br />MOTION CARRIED 4-0. <br /> <br />4.4. Review Proctor Avenue Easement ReQuest <br /> <br />The City Administrator indicated that staff is in the process of <br />sending out letters to home owners on the east side of Proctor to <br />acquire sidewalk easements for the Proctor Avenue improvement Project. <br /> <br />The City Administrator stated that the sidewalk has been deleted from <br />the west side of project, but requested authorization to acquire <br />property on the west side for future sidewalk or pathway development. <br />It was the consensus of the City Council to send an easement <br />acquisition letter to all the residents on Proctor for sidewalk pathway <br />easement purchases from the City of Elk River. <br /> <br />4.5. Gospodor Appraisal <br /> <br />The City Administrator indicated that Shenehon and Associates have <br />submitted an executive summary of an appraisal for the Gospodor <br />property. <br /> <br />e <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO ACCEPT THE EXECUTIVE SUMMARY OF THE <br />APPRAISAL BY SHENEHON AND ASSOCIATES AND TO FORWARD THE APPRAISAL TO <br />MR. GOSPODOR'S ATTORNEY, AND TO AUTHORIZE THE CITY ADMINISTRATOR TO <br />WORK ON THE LAND PURCHASE TERMS AND CONDITIONS WITH MR. GOSPODOR'S <br />ATTORNEY AND FURTHER THAT THE CITY COUNCIL BELIEVES THAT THE APPRAISAL <br />IS HIGH BASED ON A LOW ESTIMATE FOR FUTURE SPECIAL ASSESSMENTS AND A <br />HIGH SELLING PRICE OF EACH FUTURE LOT ON ORONO LAKE. COUNCILMEMBER <br />DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br />
