City Council Minutes June 10, 1991 Page 2 e COUNCILMEMBER KROPUENSKE MOVED TO ACCEPT THE DEED CONVEYING TITLE FROM THE ELK RIVER HARDWARE COMPANY TO THE CITY OF ELK RIVER. COUNCILMEMBER DIETZ SECONDED THE MOTION CARRIED 4-0. COUNCILMEMBER SCHULDT MOVED TO CONVEY THE TITLE OF THE PROPERTY FROM THE CITY TO ELK RIVER ECONOMIC DEVELOPMENT AUTHORITY. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 4.3. Fillmore Appraisal Mayor Tralle indicated that the City has received an appeal to an assessment for the Fillmore Avenue project from Mr. and Mrs. Scott Mitchell. He further indicated that it would appropriate for the City to obtain an appraisal on the land valuation as it relates to the project. The City Administrator suggested that the Council allow possibile negotiation of the assessment with Mr. and Mrs. Mitchell due to the cost which would be incurred if this assessment appeal were to go to court. e COUNCILMEMBER DIETZ MOVED TO APPROVE THE HIRING OF AN APPRAISER IF NECESSARY AND TO ALLOW STAFF TO NEGOTIATE THE ASSESSMENT APPEAL BY MR. AND MRS. MITCHELL. COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED 4-0. 4.4. Review Proctor Avenue Easement ReQuest The City Administrator indicated that staff is in the process of sending out letters to home owners on the east side of Proctor to acquire sidewalk easements for the Proctor Avenue improvement Project. The City Administrator stated that the sidewalk has been deleted from the west side of project, but requested authorization to acquire property on the west side for future sidewalk or pathway development. It was the consensus of the City Council to send an easement acquisition letter to all the residents on Proctor for sidewalk pathway easement purchases from the City of Elk River. 4.5. Gospodor Appraisal The City Administrator indicated that Shenehon and Associates have submitted an executive summary of an appraisal for the Gospodor property. e COUNCILMEMBER KROPUENSKE MOVED TO ACCEPT THE EXECUTIVE SUMMARY OF THE APPRAISAL BY SHENEHON AND ASSOCIATES AND TO FORWARD THE APPRAISAL TO MR. GOSPODOR'S ATTORNEY, AND TO AUTHORIZE THE CITY ADMINISTRATOR TO WORK ON THE LAND PURCHASE TERMS AND CONDITIONS WITH MR. GOSPODOR'S ATTORNEY AND FURTHER THAT THE CITY COUNCIL BELIEVES THAT THE APPRAISAL IS HIGH BASED ON A LOW ESTIMATE FOR FUTURE SPECIAL ASSESSMENTS AND A HIGH SELLING PRICE OF EACH FUTURE LOT ON ORONO LAKE. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0.
