<br />City Council Minutes <br />April 15, 1991 <br /> <br />Page 5 <br /> <br />e <br /> <br />COUNCILMEMBER SCHULDT MOVED TO ADOPT RESOLUTION 91-23, A RESOLUTION FOR <br />VACATING STREET EASEMENT. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. <br />THE MOTION CARRIED 5-0. <br /> <br />6.6. Preliminary Plat Review "James Manor"/James Peterson. Sr. <br /> <br />Janelle Szklarski indicated that James Peterson, Sr. is requesting <br />preliminary plat review for James Manor Plat. She stated that the <br />proposed plat consists of six single family lots and is located between <br />Upland and Tipton Avenues south of Highway 10. <br /> <br />Robert Bischoff, Planning Commission representative, indicated that the <br />Planning Commission recommended approval with the 15 stipulations noted <br />in the 2/20/91 memo to the Planning Commission dated March 14, 1991. <br /> <br />Mayor Tralle opened the public hearing. There being no one for or <br />against the matter, Mayor Tralle closed the public hearing. <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO RECOMMEND APPROVAL OF THE PRELIMINARY <br />PLAT OF JAMES MANOR, REQUESTED BY THE DEVELOPER JAMES PETERSON, SR. FOR <br />SIX SINGLE FAMILY LOTS LOCATED BETWEEN UPLAND AND TIPTON AVENUES SOUTH <br />OF HIGHWAY 10 WITH THE FOLLOWING STIPULATIONS: <br /> <br />e <br /> <br />1. THAT THE DEVELOPER DEDICATE 30 FEET OF RIGHT-OF-WAY FOR UPLAND <br />AVENUE AND THAT PRELIMINARY PLAT APPROVAL IS CONTINGENT UPON THE <br />EASEMENT VACATION REQUEST BEING APPROVED. <br /> <br />2. THAT THE DEVELOPER IS RESPONSIBLE FOR LOT GRADING WITHIN THE PLAT <br />AND SEWER AND WATER LINES TO SERVICE THE LOTS AND THAT THIS WORK <br />IS SUBJECT TO STAFF APPROVAL. <br /> <br />3. THAT THE DEVELOPER IS RESPONSIBLE FOR THE REPAIR OF TIPTON AVENUE <br />AND UPLAND AVENUE NECESSITATED BY THE CUTS NEEDED TO SERVE THIS <br />PLAT WITH CITY SEWER AND WATER. THIS RESTORATION SHOULD CONSIST <br />OF A MINIMUM OF 5" OF AGGREGATE BASE (CLASS 5) AND 2-1/2 OF <br />BITUMINOUS SURFACING (MnDOT 2341). <br /> <br />4. THE CONTRACTOR OR DEVELOPER IS REQUIRED TO PLACE A $2,000 ESCROW <br />WITH THE CITY PRIOR TO OPEN CUTTING THE STREETS, AND WILL ALSO BE <br />REQUIRED TO FULLY RESTORE THE STREETS WITHIN FIVE WORKING DAYS OF <br />THE INITIATION OF OPEN CUTTING. <br /> <br />5. THAT THE FINAL APPROVAL OF GRADING AND DRAINAGE, SEWER, AND WATER <br />IS APPROVED BY TERRY MAURER, CITY ENGINEER. THAT THESE PLANS ARE <br />COMPLETED, REVIEWED AND APPROVED BY MR. MAURER PRIOR TO THIS PLAT <br />BEING CONSIDERED FOR FINAL PLAT APPROVAL. <br /> <br />6. THAT THE DEVELOPER IS RESPONSIBLE FOR BOULEVARD RESTORATION AND <br />RESEEDING. <br /> <br />e <br /> <br />7. THAT THE DEVELOPER PROVIDE AS-BUILTS OF THE WATER AND SEWER LINES <br />TO THE CITY. <br />
