Strikethroughs to be removed <br />Underlines to be added <br />Last Updated March 2014 <br />Parking lot means a site or structure, attached or detached, devoted to the off-street parking of <br />motor vehicles, including parking spaces, aisles, access drives, and landscaped areas, and providing <br />vehicular access to a public street. <br /> <br />Parks shall mean public or private land dedicated or designated for passive or active recreational <br />uses including, but not limited to, dedicated city, county, or state parks and open space, private <br />parks, and county fairgrounds. <br />Pawnbroker. <br />(1) Except as provided in subsection (2) of this definition, the term "pawnbroker" means a <br />person engaged in whole or in part in the business of lending money on the security of <br />pledged goods left in pawn, or in the business of purchasing tangible personal property to <br />be left in pawn on the condition that it may be redeemed or repurchased by the seller for a <br />fixed price within a fixed period of time. <br />(2) The following are exempt from the definition of "pawnbroker": any bank regulated by the <br />state, the comptroller of the currency of the United States, the Federal Deposit Insurance <br />Corporation, the board of governors of the Federal Reserve System, or any other federal or <br />state authority and their affiliates; any bank or savings association whose deposits or <br />accounts are eligible for insurance by the Federal Deposit Insurance Corporation or any <br />successor to it and all affiliates of those banks and savings associations; any state or <br />federally chartered credit union; and any industrial loan and thrift company or regulated <br />lender subject to licensing and regulation by the state department of commerce. <br />Pawnshop means the location at which or premises in which a pawnbroker regularly conducts <br />business. Pawnshops shall be setback 250 feet from any residential zone and 500 feet from schools, <br />parks, day care centers, churches and other pawnshops, measured from property line to property <br />line. <br />Pedestrian way means a concrete sidewalk or bituminous trail located within a public right-of-way <br />or easement across or within a block, to be used by pedestrians. <br />Permissible occupancy means the maximum number of persons permitted to reside in a dwelling <br />unit or rooming unit. <br />Personal service establishment means a place where personal services are provided to individuals on <br />the premises. Uses may include, but not limited to, beauty, hair, tanning, nail, and tattoo salons. <br />Therapeutic massage establishments when operated by a certified and licensed (by the city) massage <br />therapist, shall be considered a personal service establishment. a place where, for a fee, personal <br />services are provided to individuals on the premises. Such uses traditionally include beauty parlors, <br />and tanning salons. Therapeutic massage establishments when operated by a certified, licensed (by <br />the city) massage therapist shall be considered a personal service establishment. <br />Photovoltaic system (PV). An active solar energy system that converts solar energy directly into <br />electricity. <br />Physical recreation or training means a business that provides physical exercise, training or <br />recreation equipment and/ or space for use on site. Health and fitness centers, dance studios, and <br />gymnastics facilities shall be considered examples of such use. Training or self improvement shall be <br />an important component of the activity, and differentiate it from commercial recreation uses, where <br />sport is the predominate activity.
