The petitioner proposes to use the property in a reasonable manner not permitted by the <br />zoning ordinance; <br /> <br />The proposed residential use and driveway location are reasonable and are permitted in the <br />zoning ordinance. Additionally the wetland impacts fall under the De Minimis exemption <br />making the request reasonable for WCA purposes. <br /> <br />4. The plight of the petitioner is due to circumstances unique to the property not a <br />consequence of the petition's own action or inaction; and <br /> <br />Wetlands are not unique to properties in Elk River. This particular site has two large basins <br />that extend beyond the property. The determined driveway locations do result in some <br />impacts but remain minor. The parcels also still have buildable space for future homes that <br />will meet all required wetlands buffer setbacks. The applicant completed a wetland <br />delineation and WCA procedures to ensure all state and local rules are followed. <br /> <br />5.
