Is in harmony with the general purpose and intent of the ordinance, and <br /> <br />The general purpose and intent of the lot width ordinance is to distribute lots and driveways <br />fronting a right-of-way in accordance to the density of the zoning district. This provides for a <br />uniformed layout of properties and allowing for proper separations between structures. The <br />property has enough length to meet the required widths for three lots but the presence of various <br />wetlands limits where property lines can be located. This in turn affects where driveways can be <br />located. The intent to allow three lots in the length of right-of-way is met. <br /> <br />2. Is consistent with the City of Elk River comprehensive plan. <br /> <br />The subject parcel is guided for residential which allows for orderly residential development. The <br />request is consistent with the Comprehensive Plan. <br /> <br />Variances may be granted when the petitioner establishes that there are practical difficulties in complying <br />with the zoning ordinance. Practical difficulties means that: <br /> <br />3. The petitioner proposes to use the property in a reasonable manner not permitted by the zoning <br />ordinance; <br /> <br />The applicant is proposing to use the property in a manner as permitted by the ordinance. The <br />single lot width variance would not be required if wetlands were not present. The applicant is not <br />requesting more lots than the property can support or is allowed by the ordinance. <br /> <br />4. The plight of the petitioner is due to circumstances unique to the property not a consequence of <br />the petition's own action or inaction; and <br /> <br />The plight of the petitioner is not due to their own action or inaction. The presence of wetlands <br />is beyond their control. <br /> <br />5.
