Ryan Construction to <br />Vacate Drainage, Utility and Sidewalk Easements <br /> <br />Request <br /> <br />The applicant is requesting that certain drainage, utility and sidewalk easements be vacated in <br />plats of Elk River Crossing and Elk River Business Park. <br /> <br />Attachments <br /> <br />. Plat of Elk River Crossing 6th illustrating the Easement Locations <br /> <br />Background <br /> <br />As the Council is aware, the final plat of Elk River Crossing 6th Addition was approved at the <br />February 22, 2005 City Council meeting. This plat reconfigured Lot 1, Block 3 of Elk River <br />Crossing and Lot 1, Block 1 of Elk River Business Park into two new lots to accommodate <br />Maxsun Furniture and Tractor Supply. Five-foot drainage and utility easements are located <br />along the common boundary between the lots on the original plats and a 10-foot sidewalk <br />easement crosses Lot 1, Block 3 of Elk River Crossing. <br /> <br />Analysis <br /> <br />In order to allow construction of the Maxsun Furniture building, the sidewalk and its <br />easement need to be relocated to the new westerly property line and the easements along the <br />old common property line need to be vacated. New easements appropriate to the site will <br />be dedicated on the plat of Elk River Crossing 6th Addition. A separate sidewalk easement <br /> <br />Planning Department Mission: the orderly development of a livable and sustainable Elk River community. <br />
