<br />. <br /> <br />. <br /> <br />. <br /> <br />Elk River City Council Minutes <br />December 21, 1992 <br /> <br />Page 2 <br /> <br />Don Spotts, Planning Commission Representative, reviewed the <br />stipulations set by the Planning Commission. He stated that the <br />Planning Commission recommended approval of the request with seven <br />stipulations. <br /> <br />Mayor Tralle opened the public hearing. There being no one for or <br />against the matter, Mayor Tralle closed the public hearing. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE A CONDITIONAL USE PERMIT FOR <br />JEFF MASTLEY OF 19857 ZEBULON STREET WHICH WOULD ALLOW THE EXCAVATION <br />OF 6,200 CUBIC YARDS OF BLACK DIRT FROM A WETLAND TO CONSTRUCT AN OPEN <br />WATER POND WITH THE FOLLOWING STIPULATIONS: <br /> <br />1. THAT NONE OF THE EXCAVATED MATERIAL IS PLACED BACK INTO THE <br />WETLAND BOUNDARIES. <br /> <br />2. FOR SAFETY PURPOSES, DURING THE ENTIRE PERIOD OF THE PROJECT, ALL <br />SLOPED AREAS SHALL HAVE A MAXIMUM RATIO OF 4' HORIZONTAL TO l' <br />VERTICAL. <br /> <br />3. SLOPED AREAS SHALL BE PLANTED WITH GROUND COVER SUFFICIENT TO <br />CONTAIN THE SOIL. SUCH GROUND COVER SHALL BE TENDED AS NECESSARY <br />UNTIL IT IS SELF SUSTAINING. <br /> <br />4. <br /> <br />FOR SAFETY PURPOSES, THE POND SHALL BE NO DEEPER THAN 3-4 FEET IN <br />DEPTH. <br /> <br />5. <br /> <br />ANY EXCAVATION OR FILLING SHOULD NOT DISRUPT THE OVERALL DRAINAGE <br />PATTERNS FOR THIS AREA. <br /> <br />6. THAT THE WESTERN PROPERTY LINE OF THE LEWIS PROPERTY BE STAKED TO <br />AVOID ANY POSSIBLE ACCIDENTAL DISRUPTION OF THE TILE SYSTEM. <br /> <br />7. THAT THE CONTRACTOR AND PROPERTY OWNER WORK WITH THE DNR TO <br />CONSTRUCT A POND THAT IS BENEFICIAL TO WILDLIFE. <br /> <br />COUNCILMEMBER KROPUENSKE SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />5.2. Review Planning Commission Rules and Procedures <br /> <br />Don Spotts, Planning Commission Representative, reviewed the amended <br />version of the Elk River Planning Commission rules and procedures with <br />the City Council. <br /> <br />Pat Klaers, City Administrator, suggested that the Council delay action <br />officially adopting the rules and procedures until the newly appointed <br />and elected Planning Commission and City Council members are in <br />office. It was the consensus of the City Council to delay action on <br />this item at this time. <br /> <br />5.3. Storm Water Master Plan <br /> <br />Terry Maurer, City Engineer, stated that per Council direction he has <br />drafted a master plan proposal pertaining to storm sewer for the City <br />
