She indicated <br />that at the beginning, the City stated that everybody in the City was <br />required to be on mandatory garbage and recycling pickup. She further <br />stated that through the Appeal Board process, there were some <br />individuals and home sites that were exempted from the mandatory <br />garbage pick up. She further indicated that she appeared before the <br />Appeal Board and was not given an exemption from garbage pickup. She <br />stated she did not feel the process was fair. <br /> <br />Alvin Froelich, of 21404 Jarvis Street, stated that all families in Elk <br />River should be treated the same regarding garbage pick up. <br /> <br />5.1. Consider Sexually Oriented Land Uses <br /> <br />Mayor Tralle indicated that the Planning Commission tabled this issue <br />at the December meeting to work out final details. <br /> <br />COUNCILMEMBER DIETZ MOVED TO TABLE <br />ASSOCIATED WITH SEXUALLY ORIENTED LAND <br />7:00 P.M. AT THE ELK RIVER LIBRARY. <br />THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />THE THREE ORDINANCE AMENDMENTS <br />USES UNTIL FEBRUARY 24, 1992, AT <br />COUNCILMEMBER KROPUENSKE SECONDED <br /> <br />5.2. Consider Preliminary Plat/Replat *1 Gospodor's Orono Lake Addition by <br />the City of Elk River/Public Hearing <br /> <br />Janelle Szklarski, Zoning Assistant, stated that the City of Elk River <br />is requesting preliminary plat approval for the replat of Blocks 1 and <br />2 and Outlots A, B, and C of Gospodor's Orono Lake Addition. She <br />stated that the City plans to use the property for the construction of <br />a new City Hall, Police Station, and future Community Center. She <br />further indicated that government facilities are a conditional use in <br />R-1c zoning districts and, therefore, the City would be requesting a <br />conditional use permit in the near future. She stated that although <br />there are some issues relating to the conditional use permit that will <br />be presented this evening, the Council's duty is to consider the <br />preliminary plat approval. <br /> <br />Al Nadeau, Planning Commission Representative, indicated that the <br />Planning Commission recommended approval of the preliminary plat with <br />certain conditions. Mayor Tralle indicated that although the Council <br />is considering the preliminary plat, comments relating to the <br />conditional use permit will also be accepted. <br /> <br />Mayor Tralle opened the public hearing. <br /> <br />Cecelia Scheel, of 10271 215th Avenue North, questioned whether it was <br />mandatory for the City to go before the people with a referendum in <br />order to build the City Hall. Peter Beck, City Attorney, stated that <br />the money to build the City Hall was below the required referendum <br />amount.
