<br />The Elk River Vision <br />A welcoming community with revolutionary and spirited resourcefulness, exceptional service, and <br />community engagement that encourages and inspires prosperity <br />Request for Action <br /> <br /> <br />To <br />Planning Commission <br />Item Number <br />4.3 <br />Agenda Section <br />Public Hearings <br />Meeting Date <br />November 28, 2017 <br />Prepared by <br />Zack Carlton, Planning Manager <br />Item Description <br />City of Elk River – Ordinance Amendment <br /> Remove Planning Commission work session from <br />city ordinance, Case No. OA 17-14 <br />Reviewed by <br />Chris Leeseberg, Senior Planner <br />Reviewed by <br /> <br /> <br />Action Requested <br />Recommend, by motion, approval of the Ordinance Amendment. <br /> <br />Purpose of the Ordinance Amendment <br />The proposed amendment removes language from the ordinance stating a Planning Commission Work Session will <br />be held the second Tuesday of each month. <br /> <br />Public Benefit <br />Provides clarification to the public regarding meeting dates and time. <br /> <br />Background/Discussion <br />City ordinance section 2-299 states: <br /> <br />The planning commission shall meet regularly on the fourth Tuesday of each month to take action on its official business, <br />including planning-related items. The commission will meet on the second Tuesday of each month in work session. No action can <br />be taken at a meeting designated as a work session unless the meeting has also been called as a special meeting. Special meetings <br />may be held at any time upon the call of the chair. Notice of the time and place of a special meeting shall be communicated to the <br />members and publicly noticed at least three days prior to the meeting except in the event of an emergency. A majority of the <br />commission members shall constitute a quorum. All commission meetings shall be open to the public. Except as provided in this <br />article, the commission shall be governed by and operate pursuant to Robert's Rules of Order, Newly Revised (ninth edition). <br /> <br />Including the work session in the city code requires preparation of a meeting cancellation notice when the meeting <br />is not held. A work session on the second Tuesday of the month has not been held for over five years. To <br />eliminate unnecessary work for city staff, and confusion when the meeting is not cancelled and posted on the city’s <br />website, staff proposes removing the underlined section of the ordinances from Sec. 2-299. <br /> <br />If a work session is required in the future, staff will post the notice accordingly and within all statutory time frames <br />required of special meetings. <br /> <br />Council Meeting <br />If acted on, this item will go to the December 4, 2017, City Council meeting. <br /> <br />Attachments <br /> Ordinance Amendment <br />
