City Council Minutes November 6, 2017 Page 3 Ryan Hardin, KW Commercial — requested the requirement for tobacco shops to be at least 500 feet from schools and parks outlined in Elk River City Code 26-40 be reduced to 200 feet. Dan Weinmann, 13825 — 214`h Avenue NW — stated he applied for a budding permit and was denied due to wetland setbacks. He spoke with staff and applied for a variance last week but he isn't happy with the process and the fees and escrow he had to pay. He also expressed concern with other properties in his neighborhood that may be in violation of the wetland setback ordinance. Mr. Leeseberg indicated the escrow has been reduced but staff does not have authority to reduce the fees. Councilmember Wagner stated she is pleased Mr. Weinmann applied for a variance. She questioned if the Council should review the ordinance for future requests. She noted Mr. Weinmann mentioned new technology for deck construction that may alleviate some of the issues of the wetland setback. Mr. Leeseberg indicated the variance is scheduled for Board of Appeal in November and if denied the Council will see the request the first meeting in December. 6.1 2017 Recognition of Beautification Awards Ms. Eddy presented the staff report.
