He indicated that a resident received a letter from Mel Beaudry who had <br />completed a market value analysis on a home in the area. The letter indicated <br />that the mining operation would decrease the property value by 20 - 25%. <br /> <br />Mr. Leary suggested that the Shiely Company alter their plans and begin mining <br />the property to the north to prevent intrusion on the residents. This would also <br />allow the gravel trucks to access Highway 169 and eliminate the use of County <br />Road 33. He indicated this proposal would give the City some time to study <br />County Road 33 and make corrections. <br /> <br />Steve Rohlf indicated that he has met with the residents and feels that the <br />stipulations in Staff's memo address all of residents' concerns. <br /> <br />Darrell Thompson, 20680 Watson Street. indicated his concern of safety on County <br />Road 33. He further indicated his concern of decreasing property values. <br /> <br />Derrick Ford, indicated his concern of safety for the children in regard to the <br />drop-off created by the mining. He further indicated his concern regarding traffic <br />and school buses. <br /> <br />There being no further comments, Mayor Duitsman closed the public hearing. <br /> <br />e <br /> <br />Councilmember Scheel indicted that the traffic issue on County Road 33 does not <br />end on Proctor Avenue. She indicated that it is not just a Shiely issue. She further <br />indicated that devaluation of property values is something all residents face. <br /> <br />Mayor Duitsman indicated that this area has been designated for gravel mining <br />since the consolidation of the City. He indicated that staff has addressed the <br />issues of concern and that the resources need to be mined. <br /> <br />Chris Kreger, Planning Commission Representative indicated that the Shiely <br />Company has cooperated with the process. Staff and the Shiely Company have <br />worked diligently with the property owners. <br /> <br />Council member Holmgren indicated that the application has been reviewed by <br />the Planning Commission, City Council and Staff. He stated that he felt the <br />concerns have been addressed. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE CONDITIONAL USE PERMIT <br />REQUEST BY SHIELY COMPANY FOR MINERAL EXCAVATION AND PROCESSING, CASE <br />NO. CU 94-31, WITH THE FOLLOWING CONDITIONS: <br /> <br />1. <br /> <br />ALL MINERAL EXCAVATION AND PROCESSING OPERATIONS ON THE <br />PROPERTY SHALL COMPLY WITH THE CITY'S MINERAL EXCAVATION, ZONING <br />AND OTHER APPLICABLE ORDINANCES; WITH THE TERMS OF THIS <br />CONDITIONAL USE PERMIT AGREEMENT AND THE LICENSE AGREEMENT TO BE <br />EXECUTED BY THE CITY AND OPERATOR; WITH THE CITY OF ELK RIVER'S <br />ENVIRONMENTAL IMPACT STATEMENT ON MINERAL EXCAVATION; AND WITH <br />THE APPLICATION MATERIALS AND PLANS SUBMITTED BY THE OPERATOR, <br />WHICH PLANS AND MATERIALS ARE THE BASIS FOR THE CITY'S APPROVAL OF <br />THE CONDITIONAL USE PERMIT. <br /> <br />e <br />
