That § 38-164, Re- strictions on issuance of premises permit of the City of Elk River Code of Ordinances shall be amended to read as follows: (a) The city reserves the right to disapprove a premises permit application for individual bingo oc- casions, raffle games, and pull -tab operations for any of the following reasons: (1) Violation by the applicant of any statute, rule, regulation or ordi- nance relating to gambling. (2) Failure to make reports re- quired by any applicable ordinance, rule, regulation or statute. (3) Any reason which would justify the state gambling central board in denying an application for a license. (b) No premises permit will be approved unless: (1) The organization is conduct- ing the lawful gambling on the Promises of a church or a fraternal, veterans', or other nonprofit orga- nization, or on the premises of an on -sale liquor license of the city. (2) The physical site for the or- ganization§ headquarters or the registered business office of the organization is located within the city's trade area. (3) Preference shall be given to organizations located in the City of Elk River that meet all the requlm- ments of the state and city gam- bling laws. (c) Only one premises permit shall be allowed per premises for lawful gambling operations. Up to three premises permits shall be allowed per organization for lawful gambling operations in the city. SECTION 2. That this ordinance shall take effect upon adoption and be published as provided by law.
