<br />Request for Action <br /> <br /> <br />To Item Number <br /> <br />Mayor and City Council 8.1 <br />Agenda Section Meeting Date Prepared by <br /> <br />General BusinessNovember 6, 2017Chris Leeseberg, Senior Planner <br />Item Description Reviewed by <br />Dancing Crane Acres Trail Easement Michael Hecker, Parks and Recreation Director <br /> <br />Zack Carlton, Planning Manager <br />Reviewed by <br />Cal Portner, City Administrator <br /> <br />Action Requested <br /> <br />Remove, by motion, Condition #4 of the Dancing Crane Acres plat requiring a 15’ trail easement on the <br />east side of Meadowvale Road outside of the right-of-way. <br /> <br />Background/Discussion <br />The City Council reviewed the subject plat on October 2, 2017, and required a 15’ trail easement be <br />outside of the county right-of-way. The plat reviewed by the Council provided a 33’ wide county right- <br />of-way within the subject plat. Since approval, the county has stated they will require a 50’ of right-of- <br />way, which is an additional 17’ of property. During the review process, the county indicated they had no <br />concerns with the proposed plat. <br /> <br />Based on the new 50’ right-of-way requirement, staff contacted the county for clarification as to whether <br />or not a publicly-owned trail could be placed within the right-of-way limits. The county stated a trail can <br />be located within their 50’ right-of way. With this guidance, a future trail in the wider right-of-way will be <br />in the same location as it would have been with the required easement and 33’ right-of-way, as <br />recommended by the Parks and Recreation Commission. There is also a concern with the proximity of <br />the existing barn on the property. If the 15’ easement is required in addition to the 50’ right-of-way, it <br />will be approximately 5’ away from the northwest comer of the barn. <br /> <br />Staff requests the Council remove Condition #4 of the Dancing Crane Acres plat requiring the 15’ trail <br />easement outside of the right-of-way as the trail opportunity is available within the 50’ county right-of- <br />way. <br /> <br />Attachments <br /> <br /> <br /> <br />Right-of-way/Trail Exhibit <br /> <br /> <br />The Elk River Vision <br />A welcoming community with revolutionary and spirited resourcefulness, exceptional <br />service, and community engagement that encourages and inspires prosperity <br />
