THE MOTION CARRIED 4-0. <br /> <br />7.3. John Weicht/Kennedy Transmission Reauest for a CQnditional Use Permit. Public <br />Hearina. Case No. CU 95"'()6 <br /> <br />City Planner Steve Ach indicated that the Elk River Auto Mall is requesting a <br />conditional use permit for a 3,500 square foot auto repair facility to be occupied <br />by Kennedy Transmission. The facility will be located north of Main Street. west of <br />Carson Street, and immediately south of the new ABRA Auto Body. Steve Ach <br />reviewed the staff report for this request. He noted that the Planning Commission <br />recommended approval of the conditional use permit. <br /> <br />Mayor Duitsman opened the public hearing. There being no one for or against <br />the matter. Mayor Duitsman closed the public hearing. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE CONDITIONAL USE PERMIT <br />FOR THE ELK RIVER AUTO MALL, LLC, TO OPERATE AN APPROXIMATELY 3,500 SQUARE <br />FOOT AUTO REPAIR FACILITY TO BE OCCUPIED BY KENNEDY TRANSMISSION WITH THE <br />CONDITIONS SET FORTH IN THE STAFF REPORT. COUNCILMEMBER DIETZ SECONDED <br />THE MOTION. THE MOnON CARRIED 3-0-1. Council member Scheel abstained. <br /> <br />7.4. <br /> <br />Ron and Paula Dargis Reauest for Shoreland Variance, Public Hearina, Case No. V <br />95-03 <br /> <br />e <br /> <br />Planning Assistant Gary Schmitz indicated that Ron and Paula Dargis are <br />requesting a 22 foot variance to the 50 foot shoreland setback requirement for <br />Lake Orono. He noted that the property is located at 1946 Main Street, Lot 5 and <br />6, Block 2, Orono Addition. Gary Schmitz reviewed the staff report for this issue. <br />He noted that the Department of Natural Resources (DNR) has reviewed the <br />request and has recommended approval. He further noted that staff is <br />recommending approval based on the findings stated in staff's memo dated <br />June 19, 1995. Gary Schmitz further noted that the Planning Commission <br />concurred with staff's findings and recommended approval of the variance. <br /> <br />Mayor Duitsman opened the public hearing. There being no one for or against <br />the matter. Mayor Duitsman closed the public hearing. <br /> <br />COUNCILMEMBERSCHEEL MOVED TO APPROVE THE 22 FOOT VARIANCE TO THE 50 <br />FOOT SHORELAND SETBACK REQUIREMENT REQUESTED BY PAULA AND RON DARGIS <br />FOR PROPERTY LOCATED AT LOT 5 AND 6, BLOCK 2, ORONO ADDITION, BASED ON <br />THE FOUR FINDINGS AS LISTED IN STAFF'S MEMO TO THE MAYOR AND CITY COUNCIL <br />DATED JUNE 19, 1995. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE <br />MOTION CARRIED 4-0. <br /> <br />e <br />
