<br />Elk River City Council Minutes <br />February 27,1995 <br /> <br />Page 6 <br /> <br />e <br /> <br />7.4. <br /> <br />Variance Reauest by Paul LeFebvre, Public Hearinq, Case No. V 94-18 <br /> <br />Planning Assistant Gary Schmitz stated that Paul LeFebvre is requesting a variance <br />to exceed the maximum size of an accessory structure. The maximum size <br />allowed is 2,000 feet. The site is in a 2.5 acre residential zone; however, Mr. <br />LeFebvre's lot is one acre in size. <br /> <br />Planning Commission representative Chris Kreger provided information on the <br />Commission's review of this request. The Planning Commission recommended <br />denial of the request. <br /> <br />Mayor Duitsman opened the public hearing. There being no one for or against <br />the matter, Mayor Duitsman closed the public hearing. <br /> <br />Paul LeFebvre indicated that he was present to answer any questions that the <br />Council may have. <br /> <br />The City Council felt the required minimum area for a garage should not be <br />included in determining total accessory space. <br /> <br />COUNCILMEMBER SCHEEL MOVED TO APPROVE THE VARIANCE REQUEST. <br />COUNCILMEMBER FARBER SECONDED THE MOTION. <br /> <br />e <br /> <br />Council member Scheel and Councilmember Farber withdrew their motion and <br />second. <br /> <br />COUNCILMEMBER SCHEEL MOVED TO DIRECT STAFF TO PREPARE A RESOLUTION FOR <br />APPROVAL OF THIS VARIANCE WITH FINDINGS AND TO PRESENT THE RESOLUTION AT <br />THE 3/6/95 CITY COUNCIL MEETING. COUNCILMEMBER FARBER SECONDED THE <br />MOTION. THE MOTION CARRIED 4-1. Councilmember Dietz opposed. <br /> <br />7.5. Consider Conditional Use Permit Reauest by Charlotte Koon, Public Hearina, Case <br />No. CU 94-39 <br /> <br />Planning Assistant Gary Schmitz provided background information on this request. <br />He stated Charlotte Koon is requesting to operate a therapeutic massage <br />establishment from the Martin Plaza building. <br /> <br />Mayor Duitsman opened the public hearing. There being no one for or against <br />the matter, Mayor Duitsman closed the public hearing. <br /> <br />COUNCILMEMBER FARBER MOVED TO APPROVE THE CONDITIONAL USE PERMIT <br />REQUEST BY CHARLOTTE KOON TO OPERATE A THERAPEUTIC MASSAGE <br />ESTABLISHMENT FROM THE EXISTING MARTIN PLAZA BUILDING WITH THE CONDITION <br />THAT THE APPLICANT RECEIVE APPROVAL OF A THERAPEUTIC MASSAGE LICENSE BY <br />THE CITY COUNCIL. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE <br />MOTION CARRIED 5-0. <br /> <br />e <br />
