Owner's Covered Risk No. 2(c), which reads as follows, is hereby deleted: (c) Any <br />encroachment, encumbrance, violation, variation, or adverse circumstance affecting the Title that <br />would be disclosed by an accurate and complete land survey of the Land. The term <br />"encroachment" includes encroachments of existing improvements located on the Land onto <br />adjoining land, and encroachments onto the Land of existing improvements located on adjoining <br />land. <br />2. Owner's Covered Risk No. 10, which reads as follows, is hereby deleted: Any defect in or lien or <br />encumbrance on the Title or other matter included in Covered Risks 1 through 9 that has been <br />created or attached or has been filed or recorded in the Public Records subsequent to Date of <br />Policy and prior to the recording of the deed or other instrument of transfer in the Public Records <br />that vests Title as shown in Schedule A. <br />3. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first appearing in <br />the public records or attaching subsequent to the Effective Date but prior to the date the <br />proposed Insured acquires for value of record the estate or interest or mortgage thereon covered <br />by this Commitment. <br />4. Any encroachment, measurement, party walls, or other facts which a correct survey of the <br />premises would show. <br />5. Rights or claims of parties in possession not shown by the public records. <br />6. Easements, or claims of easements, not shown by the Public Records. <br />7. Any lien, or right to lien, for services, labor, or material heretofore or hereafter furnished, <br />imposed by law and not shown by the Public Records. <br />8. All assessments and taxes due and payable in 2017, and thereafter. <br />9. No coverage is provided for municipal code compliance matters and fees, including, but not <br />limited to, utilities, water, or sewer services, or fees for tree, weed, grass and snow or garbage <br />removal, police boarding, vacant building registration and zoning. <br /> <br />10. Any and all connection, hook-up, nuisance, and/or condemnation charges. <br />11. Tenancy rights, either as month to month, or by virtue of written leases of persons in possession <br />of any part of the subject property. <br />12. Right of the County of Sherburne to limit access to C.S.A.H. No. 33 as shown on the Plat of Trace <br />Heights. <br />13. An easement for transmission line purposes to The Rural Cooperative Power Association in the <br />document recorded February 28, 1953 as 79570 in Book Q of Misc., page 489 of Official Records.
