SUMMARY OF PROPOSAL <br /> On June 16, 2017, Elk River Municipal Utilities(the Municipal)) and Wright-Hennepin <br /> Cooperative Electric Association (the Cooperative), collectively the Parties,jointly filed a <br /> petition under Minn. Stat. Section 2166.39, subd. 3, asking the Minnesota Public Utilities <br /> Commission (Commission)to update the Parties' service territory boundaries. <br /> II. DEPARTMENT ANALYSIS <br /> A. ASSIGNED SERVICE AREA <br /> Minnesota Statutes section 2166.39, subd. (3) states: <br /> ... the commission may on its own or at the request of an electric utility make changes in <br /> the boundaries of the assigned service areas, but only after notice and hearing as <br /> provided for in sections 216B.17 and 216B.18. <br /> The Municipal and the Cooperative have agreed to a permanent transfer of the exclusive right <br /> to provide electric service, as generally depicted in the map attached as Exhibit A to the <br /> petition. The Municipal will transfer to the Cooperative (Area 1): Lots 10—13 of Block 3 and <br /> Lots 1—3 of Mississippi Cove in Otsego. The Cooperative will transfer to the Municipal (Area 2): <br /> Lots 1—4 of Block 3 and Lots 1—7 of the Villas in Otsego. Greater detail of Areas 1 and 2 are <br /> depicted in Exhibits B and C to the Petition respectively. <br /> The Cooperative is currently providing electric service to Area 1, and the Municipal is currently <br /> providing temporary service to one location in Area 2. <br /> 39 <br />
