COMMil MERCE DEPARTMENT Before the Minnesota Public Utilities Commission Comments of the Minnesota Department of Commerce Division of Energy Resources Docket No. E234, E148/SA-17-489 I. SUMMARY OF PROPOSAL On June 16, 2017, Elk River Municipal Utilities(the Municipal)) and Wright-Hennepin Cooperative Electric Association (the Cooperative), collectively the Parties,jointly filed a petition under Minn. Stat. Section 2166.39, subd. 3, asking the Minnesota Public Utilities Commission (Commission)to update the Parties' service territory boundaries. II. DEPARTMENT ANALYSIS A. ASSIGNED SERVICE AREA Minnesota Statutes section 2166.39, subd. (3) states: ... the commission may on its own or at the request of an electric utility make changes in the boundaries of the assigned service areas, but only after notice and hearing as provided for in sections 216B.17 and 216B.18. The Municipal and the Cooperative have agreed to a permanent transfer of the exclusive right to provide electric service, as generally depicted in the map attached as Exhibit A to the petition. The Municipal will transfer to the Cooperative (Area 1): Lots 10—13 of Block 3 and Lots 1—3 of Mississippi Cove in Otsego. The Cooperative will transfer to the Municipal (Area 2): Lots 1—4 of Block 3 and Lots 1—7 of the Villas in Otsego. Greater detail of Areas 1 and 2 are depicted in Exhibits B and C to the Petition respectively. The Cooperative is currently providing electric service to Area 1, and the Municipal is currently providing temporary service to one location in Area 2. 39
