Sample work order contracts are attached and incorporated into this contract as Exhibits A, Band C. <br /> <br />2 Scope ofWorklDeliverables <br />2.1 The Local Government, whose relationship to the State under this contract will that be of an independent <br />contractor, may be requested to perform any of the following services under individual work order contracts. <br /> <br />2.1 (a) Path A - Routine Maintenance. The Local Government will provide it's own personnel to perform <br />non-professional/technical services as requested by the State. All services must be performed by an <br />employee with sufficient skills, training, expertise or certification to perform such work. Services <br />provided under a Path A work order may include, but are not limited to; lane or edge striping, pavement <br />message painting, sign repair, guardrail repair, carcass removal, or equipment repair. The Local <br />Government will also provide professional/technical supervisory personnel to oversee the perfonnance of <br />such work and ensure compliance with applicable standards. <br /> <br />2.1 (b) .Path B - Administrative or En2ineerin2 Services. The Local Government will provide it's own <br />personnel to perform professional/technical services as requested by the State. All services must be <br />performed by an employee with sufficient skills, training, expertise or certification to perform such work. <br />Services provided under a Path B work order include, but are not limited to, public relations, graphics <br />preparation, open house set up, engineering services, recommendations/reports for foundations, pavement <br />rehabilitation or environmental documentation, surveying, right of way assistance including acquisition <br />(but excluding the use of eminent domain) and relocation assistance, geometric layouts, or final <br />construction plans. <br /> <br />2.1 (c) Path C - Local A2encv Contracts. The Local Government will provide it's own personnel to perform' <br />professional/technical engineering services in order to let and administer State requested construction <br />projects. These projects may be completed in conjunction with local projects. All services must be <br />performed by an employee with sufficient skills, training, expertise or certification to perform such work. <br />Services provided under a Path C work order include, but are not limited to mill and overlay, seal coat, <br />guardrail, signing or channelization. <br /> <br />2.2 When a need is identified, the State and the Local Government will discuss the proposed work and the Local <br />Government's ability to perform the proposed work. If the Local Government is able to perform such work, the <br />parties will negotiate the specific and detailed work tasks and cost. The State will then prepare a work order <br />contract. Generally, a work order contract will be limited to one specific project/engagement, although "on call" <br />work orders may be prepared for certain types of services, especially those "routine maintenance" items <br />identified in "Path A". A work order must be fully executed by the parties prior to work being commenced. The <br />Local Government will not be paid for work perfonned prior to authorization by the State. <br /> <br />2.3 Deliverables are the work products created or supplied by the Local Government pursuant to the terms of the <br />contract. Work order contracts will include the details of deliverables to be provided by the Local Government. <br /> <br />3 Responsibilities of the Local Government <br />Each work order will set forth particular requirements for that project/engagement. The following tenns apply to all <br />work orders issued pursuant to this Master Contract. <br /> <br />3.1 The Local Government will furnish and assign a publicly employed licensed engineer (Project Engineer), to <br />be in responsible charge of the project(s) and to supervise and direct the work to be performed <br />under each work order. The services of the Local Government to be performed hereunder may not be otherwise <br />assigned, sublet, or transferred unless approved in writing by the State's authorized representative. This written <br />consent will in no way relieve the Local Government from its primary responsibility of the work. <br /> <br />2/15/2005 2 <br />
