ACCESS TO EDUCATION RECORDS <br />School officials shall allow the Police to inspect and copy any public records maintained by the <br />school including student directory information such as yearbooks; however, the Police may not <br />inspect and/or copy private educational data except in emergency situations. If some <br />information in a student's cumulative record is needed in a health and safety emergency or to <br />protect the health or safety of the student or other individuals, school officials may disclose to <br />the Police that information which is needed to respond to the emergency situation based on the <br />seriousness of the threat to someone's health or safety; the need for the data to address the <br />emergency situation and the extent to which time is of the essence. If private educational data <br />is needed, but no emergency situation exists, the information may be released upon issuance of <br />a valid court order, search warrant or subpoena to produce the records. <br />11. GOVERNMENT DATA PRACTICES ACT <br />The City and District must comply with the Family Educational Rights and Privacy Act ("FERPA") <br />and the Minnesota Government Data Practices Act, Minnesota Statutes Chapter 13, as it applies <br />to all data provided by District in accordance with this agreement, and as it applies to all data <br />created, collected, received, stored, used, maintained, or disseminated by the City in accordance <br />with this agreement.. <br />12. MINNESOTA LAWS GOVERN <br />The laws of the State of Minnesota shall govern all questions and interpretations concerning the <br />validity and construction of this Agreement and the legal relations between the parties sand <br />performance under this Agreement. <br />13. REPORTING <br />The Police will provide statistical reporting on selected data to the School District a minimum of <br />two times per school year (mid -year and end -of -year reports). <br />
