Memorandum TO: MAYOR AND CITY COUNCIL FROM: STEPHEN ROHLF, BUILDING AND ZONING ADMINISTRATOR DATE: OCTOBER 18,1999 :5f( SUBJECT: WETLAND CONSERVATION ACT DECISION - SEVEN OAKS - WCA99-5 Windsor Development is proposing to fill 3,051 square feet of Type 3 wetland to accommodate the residential development of Seven Oaks. The location of the wetland to be filled and the replacement wetland are identified on the attached map of the plat. . Up to three lots will need to be eliminated from this plat or one lot eliminated and major retaining walls erected if this wetland is not filled. Since the plat improvements will alter the hydrology of this area and a small isolated wetland between urban lots tends to get degraded, the Technical Panel felt it is more advantageous to fill this wetland and replace it with wetland in a more appropriate location. FINDINGS Schoell & Madson, Inc. prepared a Wetland Delineation Report for the property, dated June 10, 1999 and a Wetland Replacement Plan for the project, dated August 20, 1999. The Technical Evaluation Panel was convened on this issue on 8/26/99. On August 27, 1999, the city sent out combined notification ofthe proposed filling and replacement plan to the necessary agencies. No negative comments were received by the city on the proposed wetland plan. RECOMMENDATION Staff recommends approval of the proposed filling and mitigation plan for this project with the following stipulations: 1. That a restrictive covenant and drainage and utility easement be recorded on the mitigation areas. . 2. That the Developer's Agreement for the project includes language that places the responsibility for the success of the wetland mitigation on the developer. 13065 Orono Parkway. P.O.
