The location of the wetland to <br />be filled and the replacement wetland are identified on the attached map of the plat. <br /> <br />. <br /> <br />Up to three lots will need to be eliminated from this plat or one lot eliminated and major <br />retaining walls erected if this wetland is not filled. Since the plat improvements will alter <br />the hydrology of this area and a small isolated wetland between urban lots tends to get <br />degraded, the Technical Panel felt it is more advantageous to fill this wetland and replace <br />it with wetland in a more appropriate location. <br /> <br />FINDINGS <br /> <br />Schoell & Madson, Inc. prepared a Wetland Delineation Report for the property, dated <br />June 10, 1999 and a Wetland Replacement Plan for the project, dated August 20, 1999. <br /> <br />The Technical Evaluation Panel was convened on this issue on 8/26/99. <br /> <br />On August 27, 1999, the city sent out combined notification ofthe proposed filling and <br />replacement plan to the necessary agencies. <br /> <br />No negative comments were received by the city on the proposed wetland plan. <br /> <br />RECOMMENDATION <br /> <br />Staff recommends approval of the proposed filling and mitigation plan for this <br />project with the following stipulations: <br /> <br />1. That a restrictive covenant and drainage and utility easement be recorded on the <br />mitigation areas. <br /> <br />. <br /> <br />2. That the Developer's Agreement for the project includes language that places <br />the responsibility for the success of the wetland mitigation on the developer. <br /> <br />13065 Orono Parkway.
