The City Council is asked to approve <br />Resolution No. 99-77, approving the land exchange with the Elk River Country <br />Club. The City Council is also asked to approve easement and license <br />agreements for the golf course and city use of the property. <br /> <br />COUNCILMEMBER DIETZ MOVED APPROVAL OF RESOLUTION NO. 99-77, DECLARING <br />THE SALE OF CITY PROPERTY TO ELK RIVER COUNTRY CLUB, THE DRIVEWAY <br />EASEMENT AGREEMENT, ACCESS DRIVE EASEMENT AGREEMENT, AND LICENSE <br />AGREEMENT WITH ELK RIVER COUNTRY CLUB. COUNCILMEMBER THOMPSON <br />SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.4. Request bv St. Andrew's Church for Variance from Sian Ordinance Reaulations, <br />Public Hearing Case No. V 99-13 <br /> <br />Staff report by Stephen Wensman. The Church of St. Andrew requests a variance <br />to reduce the setback from the property line from ten feet to 3 feet in the R2a <br />Zoning District. Mr. Wensman stated that the Board of Adjustments denied the <br />request because they did not feel the request met the five findings necessary for <br />granting a variance. Mr. Wensman reviewed alternate locations for placement <br />of the proposed sign. <br /> <br />Mayor Klinzing opened the public hearing. <br /> <br />e <br /> <br />Julie Kastendick, 810 Fawn Road, representing Sf. Andrew's Church, provided <br />photos of the alternate sites proposed by staff, stating why the church did not <br />feel any of these sites were appropriate. Ms. Kastendick explained that they <br />spent $486 on public notification of the surrounding residents and not one of <br />them has come forward in opposition to the proposed sign. She reviewed the <br />design of the etched glass sign, noting that the sign will be encased in Plexiglas to <br />prevent breakage. Ms. Kastendick stated that there are two other <br />nonconforming signs in the area. <br /> <br />Mr. Wensman stated that one of the signs referred to by Ms. Kastendick is <br />nonconforming, since no permit was obtained to erect the sign, and he was not <br />aware of any other signs that have less than the required 10 foot setback. <br /> <br />Discussion followed regarding the alternate sites that were proposed. <br /> <br />Ken Williams, Brentwood Lane, representing the Sign Committee for Sf. Andrew's, <br />argued why the site chosen by them was best suited for location of the sign. He <br />cited visibility, parking needs, and snowplowing issues as reasons for not <br />considering the sites identified by staff. Mr. Williams stated that Councilmember <br />Farber supported the variance request and asked that if his vote appeared <br />critical, that the item be tabled to a future meeting. Mr. Williams felt that since <br />there were no safety issues or concerns from neighboring residents, the city should <br />approve the request. <br /> <br />e <br /> <br />The council discussed the possibility of removing one or two parking stalls in order <br />to meet the required setback. <br />
