THAT THE NUMBER OF LOTS BE REDUCED FROM THE REQUESTED <br />27 DOWN TO 24 LOTS. <br /> <br />Staff does not concur with the Commission's concerns about the density. To the <br />west, Knollwood West Addition contains many one acre lots without any preserved <br />open space. The proposed density appears to be in keeping with the land use near <br />the site. The City Attorney will be in attendance at the City Council meeting to <br />address any legal issues or concerns regarding the appropriateness of the PUD <br />process. <br /> <br />Recommendation <br /> <br />Staff and the Planning Commission recommended that the City Council approve the <br />rezoning from RIa (Single Family Residential) to PUD (Planned Unit Development) <br />based on the following findings: <br /> <br />1. A PLANNED UNIT DEVELOPMENT ALLOWS A COMPREHENSIVE <br />REVIEW OF DEVELOPING THE PROPERTY. <br /> <br />2. A PLANNED UNIT DEVELOPMENT ALLOWS FOR FLEXIBILITY IN <br />SUBDIVISION DESIGN. <br /> <br />. <br /> <br />Staff also recommends that the City Council approve the rezoning from RIa (Single <br />Family Residential) to PUD (Planned Unit Development) based on the following <br />finding: <br /> <br />3. THE REZONING IS CONSISTENT WITH THE COMPREHENSIVE PLAN <br />AND THE SHORELAND ORDINANCE. <br /> <br />The Planning Commission recommends approval of the Preliminary Plat and <br />Conditional Use Permit for a single family residential development with the <br />following conditions: <br /> <br />1. A DEVELOPERS AGREEMENT AND PUD AGREEMENT BE PREPARED <br />OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL <br />AND INSTALLATION OF IMPROVEMENTS. <br /> <br />2. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED. <br /> <br />3. THAT WRITTEN APPROVAL IS OBTAINED FROM THE APPLICABLE <br />PROPERTY OWNERS, PRIOR TO GRADING OFF SITE ON PRIVATE <br />PROPERTY. <br /> <br />4. THAT SOIL BORINGS BE CONDUCTED ON LOTS AS REQUIRED BY <br />THE CITY ENGINEER PRIOR TO FINAL PLAT TO ENSURE <br />SUITABILITY FOR SEPTIC SYSTEMS. <br /> <br />5.
