<br />rei ----'\) <br />( ); <br />tli< <br /> <br />ITEM 5.1. <br /> <br /> <br />Memorandum <br /> <br />TO: MAYOR AND CITY COUNCIL <br /> <br />FROM: STEPHEN ROHLF, BUILDING AND <br />ZONING ADMINISTRATOR <br />5R <br /> <br />DATE: OCTOBER 11, 1999 <br /> <br />SUBJECT: WETLAND CONSERVATION <br />ACT DECISION - PRESERVE <br />ESTATES - WCA 99 - 6 <br /> <br />Bridgeland Development is proposing to fill portions of two wetlands to accommodate <br />the residential development of Preserve Estates. The locations of the two wetlands to be <br />filled, labeled "Impact Area", are identified on the attached map as is the "Replacement <br />Wetland Area". <br /> <br />To accommodate a future road connection to the north of this plat, 4,070 square feet of <br />Type 7 wetland is proposed to be filled. The Council will note on the attached map, <br />terrain and numerous wetlands in this area make it impossible to totally avoid wetlands. <br /> <br />. To the south, 1,350 square feet of Type 2 wetland is proposed to be filled to connect the <br />road system for this plat in with the city's existing road system. This connection is also <br />impossible to make without filling some wetland. <br /> <br />Normally up to 5,000 square feet of Type 2 & 7 wetland can be filled for a project as an <br />exemption to the Wetland Conservation Act called the de minimis amount. However, in <br />this case, the property is located in a shore land district and the de minimis amount is <br />reduced to 400 square feet. <br /> <br />FINDINGS <br /> <br />Kjolhaug Environmental Services Company prepared a Wetland Delineation Report for <br />the property, dated August 17, 1999. <br /> <br />The Technical Evaluation Panel was convened on this issue on 8/26/99. <br /> <br />On site sequencing was performed on September 1, 1999 by Stephen Rohlf and Paul <br />Kjolhaug. <br /> <br />On September 1, 1999, the city sent out combined notification of the proposed filling and <br />replacement plan to the necessary agencies. <br /> <br />. <br /> <br />No negative comments were received by the city on the proposed wetland plan. <br /> <br />13065 Orono Parkway · P.O.
