Approval by Cit X - City hereby approves the Project as shown in the <br />attached exhibits provided, however, that insofar as the exhibits vary <br />from the written terms of this PUD Agreement, the written terms shall <br />govern. This approval is subject to the requirement that final plat <br />approval be obtained and the City Council's right to attach such <br />conditions, as it deems appropriate to the final plat approval. <br />5.) Public Improvements - Public Improvements for the Project shall be <br />installed and paid for as provided by the terms of the Developer's <br />Agreement entered into between Developer and City. Any violation by <br />Developer of the terms of the Developer's Agreement shall be a <br />violation of this PUD Agreement, and shall be grounds for City <br />invoking against Developer the remedies provided by this PUD <br />Agreement, including denial of site plan review or approval for one or <br />more of the lots in the Project. <br />6.) Maintenance of Project Areas - <br />(01) Homeowners Association - Developer shall provide the City with <br />copies of the Homeowners Association legal documents for review and <br />approval by the City Attorney. Such documents may include, but are <br />not limited to, Articles of Incorporation, Declaration, Bylaws, and <br />Preliminary Budget. <br />(02) Maintenance Agreements - Developer shall provide evidence of <br />satisfactory provision for control and maintenance of jointly used or <br />commonly owned parking, drainage and landscaped areas within the <br />Project. Reciprocal parking and access easements shall be provided to <br />and approved by the City Attorney prior to the issuance of certificates <br />of occupancy so as to insure satisfactory control, ownership and <br />maintenance. These agreements shall provide that the Developer and its <br />successors shall be obligated to maintain all common areas, drainage <br />areas, outlots and landscaping in the Project. <br />3. <br />5:\PLANNINGIAGREEMTS\Miss Ridge PUD.DOC <br />
