<br />Memo to City CouncillZC 99-7, P 99-10, CD 99-30 <br />September 20, 1999 <br />Page 6 <br /> <br />. <br /> <br />Recommendation <br /> <br />Staff and the Planning Commission recommended that the City Council approve the <br />rezoning from RIa (Single Family Residential) to PUD (Planned Unit Development) <br />based on the following findings: <br /> <br />1. A PLANNED UNIT DEVELOPMENT ALLOWS A COMPREHENSIVE <br />REVIEW OF DEVELOPING THE PROPERTY. <br /> <br />2. A PLANNED UNIT DEVELOPMENT ALLOWS FOR FLEXIBILITY IN <br />SUBDIVISION DESIGN. <br /> <br />Staff also recommends that the City Council approve the rezoning from RIa (Single <br />Family Residential) to PUD (Planned Unit Development) based on the following <br />finding: <br /> <br />3. THE REZONING IS CONSISTENT WITH THE COMPREHENSIVE PLAN <br />AND THE SHORELAND ORDINANCE. <br /> <br />The Planning Commission recommends approval of the Preliminary Plat and <br />Conditional Use Permit for a single family residential development with the <br />following conditions: <br /> <br />. 1. A DEVELOPERS AGREEMENT AND PUD AGREEMENT BE PREPARED <br /> OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL <br /> AND INSTALLATION OF IMPROVEMENTS. <br /> 2. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED. <br /> 3. THAT WRITTEN APPROVAL IS OBTAINED FROM THE APPLICABLE <br /> PROPERTY OWNERS, PRIOR TO GRADING OFF SITE ON PRIVATE <br /> PROPERTY. <br /> 4. THAT SOIL BORINGS BE CONDUCTED ON LOTS AS REQUIRED BY <br /> THE CITY ENGINEER PRIOR TO FINAL PLAT TO ENSURE <br /> SUITABILITY FOR SEPTIC SYSTEMS. <br /> 5. THAT SEPTIC AREAS BE FENCED DURING CONSTRUCTION TO <br /> PREVENT COMPACTION. <br /> 6. THAT A HOMEOWNERS ASSOCIATION DOCUMENT BE PREPARED, <br /> SUBJECT TO THE CITY ATTORNEY REVIEW AND APPROVAL, PRIOR <br /> TO FINAL PLAT. <br /> 7. THAT THE DNR REVIEW AND APPROVE THE HOMEOWNERS <br /> ASSOCIATION MAINTENANCE AGREEMENT FOR INDIVIDUAL <br /> SEPTICS PRIOR TO FINAL PLAT. <br />. 8.
