Staff would like to confirm the policy for
residents who want to opt out of service for garbage collection.
The solid waste ordinance requires all households in Elk River to have city contracted garbage and
recycling service. Households have not been permitted to opt out of service in the past. Organized
collection was adopted by the city in 1991 and at the time a Refuse Appeal Board was created to consider
appeals from the ordinance. The Refuse Appeal Board was abolished in 1996 after two years without any
appeals received. It was determined appeals would be handled at staff level with the stipulation citizens be
allowed to appeal staff s decision to the City Council.
This item would come back to Council at a regular meeting as an ordinance amendment if Council is
interested in maintaining the appeal process established in 1996 for opting out of garbage service.
Financial Impact
N/A
Attachments
■ Excerpt of January 8, 1996, City Council Minutes
The Elk River Vision
A avelcoming community avith revolutionary and spirited resourcefulness, exceptional p o w E A E u e r
service, and community engagement that encourages and inspires prosperity , g /
