<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION 99 - <br /> <br />A RESOLUTION OF THE CITY OF CITY OF ELK RIVER <br /> <br />A RESOLUTION REGARDING A TRAIL <br />EASEMENT FOR A PEDESTRIAN BRIDGE PROJECT. <br /> <br />WHEREAS the City of Elk River has developed plans to construct State Project 204-107-05, <br />a pedestrian bridge over Trunk Highway 169, using State and Federal funds; and <br /> <br />WHEREAS the approach trail and sidewalk to the bridge on the west side of Trunk Highway <br />169 traverse property owned by the City of Elk River; and <br /> <br />WHEREAS the Federal Highway Administration requires a dedicated trail easement for such <br />projects; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: <br /> <br />1. The land encompassing the sidewalk and pedestrian! bicycle path constructed on parcel <br />number 75-127-4302, owned by the City of Elk River, as shown on attached Exhibit A, is <br />hereby dedicated as a pedestrian easement. <br /> <br />2. <br /> <br />Such trail dedication shall remain in effect until such time as mutually agreed upon by <br />the City of Elk River and the Federal Highway Administration or its authorized <br />representatives. <br /> <br />3. The City of Elk River reserves the right to make future modifications to said trail or <br />sidewalk locations provided such new locations continue to meet Minnesota Department <br />of Transportation and Federal Highway Administration standards, provide adequate <br />access to said bridge and be covered by a trail easement. <br /> <br />Passed and adopted this 9 day of August, 1999. <br /> <br />Stephanie Klinzing, Mayor <br /> <br />ATTEST: <br /> <br />Sandra A.
