<br />. <br /> <br />. <br /> <br />. <br /> <br />City Council IvUnutes <br />February 22, 2005 <br /> <br />Page 10 <br /> <br />5.9. <br /> <br />Consider Proposals to Complete Master Grading Plan for Public \Vorks Site <br /> <br />Director of Planning Michele McPherson stated proposals have been received for <br />preparation of the master grading plan for the Public \Vorks site. The bids ranged from <br />$15,620 to $33,754. <br /> <br />Councilmember Farber stated he would be fIne with the $15,620 bid from John Oliver and <br />Associates as long as no change orders were allowed. <br /> <br />Acting Mayor Dietz stated he is concerned about accepting a bid that was less than half <br />compared to the other bids. Councilmember Farber and Gumphrey concurred. <br /> <br />Streets Superintendent Phil Hals stated he contacted John Oliver to discuss their low bid <br />and to make sure they understood what was expected of them. He stated he gave them the <br />opportunity to withdraw their bid before it was awarded but John Oliver stated they <br />understood what was expected and declined to withdraw. <br /> <br />Acting Mayor Dietz questioned Mr. Maurer as to why Howard R. Green didn't submit a bid <br />for the project. <br /> <br />Mr. Maurer stated he did not bid on the project but submitted a quote to the city <br />administrator of what Howard R. Green would have bid on the project. He stated he did not <br />bid on the project because of a concern that the estimate prepared in fall of 2004 for project <br />budget purposes was mistaken as a quote and how it would be perceived if he now <br />submitted a quote substantially lower. <br /> <br />MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY <br />COUNCILMEMBER FARBER TO ACCEPT THE BID FROM JOHN OLIVER <br />AND ASSOCIATES IN THE AMOUNT OF $15,620 WITH NO CHANGE <br />ORDERS ALLOWED FROM THE CONTRACTOR. MOTION CARRIED 3-1. <br />Acting Mayor Dietz opposed. <br /> <br />Acting Mayor Dietz stated he hoped everyone learned a lesson from this situation and that it <br />would not happen again. <br /> <br />Councilmembers Farber and Gumphrey concurred. <br /> <br />Councilmember Motin disagreed. He stated that since he has been on the Council there has <br />never been a review of comparable engineering quotes from other fIrms. He stated that this <br />exercise did not necessarily meet the objective either. <br /> <br />5.10. Consider Zane Avenue Right of\Vay Easement-Wal-Mart Expansion Proposal <br /> <br />Mr. Maurer stated he has been working with Wal-Mart on obtaining right-of-way so the city <br />can complete a 3-lane confIguration on Zane Street. He stated if the city takes any right-of <br />way, then the Wal-Mart parking lot would be non-conforming. He stated the city could <br />request a 10' sidewalk easement onto Wal-Mart's property, which would allow the city to <br />expand Zane Street for the 3-lane striping. <br />
